Dear Mr. Terry:
By letter 20-024, dated March 23, 2020 (not publicly available in the Agencywide Documents Access and Management System [ADAMS] due to the proprietary information contained within),
BWXT Nuclear Operations Group, Inc. - Lynchburg (BWXT NOG-L) requested regulatory relief from certain U.S. Nuclear Regulatory Commission (NRC) requirements to avoid potential impacts from the Coronavirus Disease 2019 (COVID-19) public health emergency. In response to that letter, the NRC staff e-mailed you a request for supplemental information (RSI) dated April 2, 2020 (ADAMS Accession No. ML20190A201).
In lieu of directly responding to that RSI, BWXT NOG-L submitted four separate requests for regulatory relief that prioritized and detailed specific portions of the original request dated March 23, 2020. These four subsequent requests for regulatory relief were granted by the NRC (see ADAMS Accession Nos. ML20107F694, ML20168B008, ML20181A109, and ML20177A211). Therefore, it is the understanding of the NRC staff that additional effort on the original request is no longer needed and NRC action on that request may be closed out. This letter concludes action on letter 20-024 and Enterprise Project Identifier L-2020-LLA-0050 is considered CLOSED.
In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room, or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
