Background===
Regulatory Guide 1.187 endorses industry guidance on implementation of 10 CFR 50.59 requirements o NEI 96-07, Rev. 1, Guidelines for 10 CFR 50.59 Implementation, endorsed by, was issued in November 2000 based on a 10 CFR 50.59 rule change made in 1999 o Recent feedback that NEI 96-07 may improve restrictions that go beyond the requirements of the regulation Public meeting held on June 4, 2020, where NEI presented three focus areas for engagement and a proposed engagement strategy:
o Focus Area 1 - Clarifying the use of more than minimal as it pertains to 10 CFR 50.59 o Focus Area 2 - Clarifying the application of General Design Criteria language in NEI 96-07, Rev. 1 o Focus Area 3 - Clarifying application of methods of evaluations 2
Inspection Manual Chapter 0335 Development
- Several public meetings held to discuss the three focus areas
- NRC working group used public engagement, agency experts, and agency-wide collaboration to develop IMC 0335 o Derived from review of several existing documents (e.g., NEI 96-07, existing Part 9900 Guidance, and Statements of Consideration for the rule) o Provides clear guidance to inspectors regarding use of PRA and risk insights in 10 CFR 50.59 evaluations
- E.g., in the 1999 Statement of Considerations, the Commission stated that the use of PRA (e.g., CDF and LERF alone) in 50.59 requires further rulemaking 3
Path Forward
- IMC 0335 was made publicly available to support discussion at a December 1 public meeting o Staff will assess any feedback as it finalizes the IMC
- IMC 0335 was delivered to regional staff on November 20 for comment
- IMC 0335 will be implemented in late January 2021 following comment resolution period
- Staff training will be conducted:
o Training sessions to support regional rollout of IMC 0335 o Awareness seminars for staff at NRC Headquarters 4
