Dear Mr. DeLaBarre:

The U.S. Nuclear Regulatory Commission received an export application (XCOM1336) dated October 26, 2020, and a supplemental letter dated November 19, 2020, from Orano Federal Services for the export of components to the Melox mixed oxide fuel fabrication facility in France.

Since the items proposed for export in this application are related to the fabrication of nuclear fuel containing plutonium, this application will require both Commission and Executive Branch review in accordance with 10 CFR 110.40(a)(3) and 110.41(a)(6), respectively. Assurances from France that the components will be subject to the terms and conditions of an agreement for cooperation are also required. As such, your assistance in obtaining the necessary Executive Branch views and assurances is kindly requested.

Additionally, please note in the applicants supplement letter that the components proposed for export are currently owned by and located at a U.S. Department of Energy (DOE) facility. The applicant has indicated it is coordinating a transaction with DOE to purchase and export the items based on DOEs need to repurpose the storage location of the components for a national security purpose. Accordingly, the applicant has requested an expedited review of this application.
