SUMMARY

OF NOVEMBER 19, 2020, MEETING WITH THE NATIONAL ORGANIZATION OF TEST, RESEARCH, AND TRAINING REACTORS, INC. TO DISCUSS PROPOSED WHITE PAPER On November 19, 2020, a Category 2 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and members of the National Organization of Test, Research, and Training Reactors, Inc. (TRTR) via Microsoft Teams. The purpose of this meeting was to discuss the white paper developed by the members of TRTR (Tom Newton Deputy Director of Center for Neutron Research at the National Institute of Standards and Technology, lead author), providing guidance on compliance with the regulations in Title 10 of the Code of Federal Regulations (10 CFR) 50.59, Changes, tests and experiments, emphasizing aspects specific to research and test reactors. The meeting notice and agenda, dated November 2, 2020, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20307A166. TRTR began the meeting by discussing the goal of the white paper as an effort to provide guidance to research reactor licensees when performing 10 CFR 50.59 evaluations. The goal was to produce a document similar to the Nuclear Energy Institute (NEI) 96-07 document titled Guidelines for 10 CFR 50.59 Implementation (ADAMS Accession No. ML003771157). The TRTR members also stated that they plan to seek NRC endorsement of the document similar to Regulatory Guide 1.187, Guidance for Implementation of 10 CFR 50.59, Changes, Tests, and Experiments.

The NRC staff asked the TRTR members to confirm that they read the NRC staff comments on the white paper and if the TRTR members had questions related to the NRC staff comments.

The TRTR members present at the meeting acknowledged that they read the NRC staff comments and understood the points raised by the NRC staff.

The NRC staff stated that the approach of generating a white paper independent of NEI 96-07 would result in a lengthy review process requiring significant resources to get the white paper into a version that could be endorsed by the NRC. The NRC staff suggested that the TRTR members reconsider the approach of the proposed white paper and to restart the white paper process beginning with revisions to NEI 96-07. The NRC staff identified regulations listed in NEI 96-07 that do not apply to Non-Power Production and Utilization Facilities (NPUFs). The NRC staff proceeded to describe the markup of NEI 96-07 Section 4, Implementation Guidance, which was provided prior to this Public Meeting (ADAMS Accession No. ML20296A669).

Following the NRC staff discussion, the TRTR members agreed with the approach to revise NEI 96-07 to make it applicable to NPUFs instead of generating a stand-alone document. The

2 TRTR members also agreed to work on one or two sections at a time and periodically meet with the NRC staff during a Public Meeting to discuss the TRTR proposed revisions.

Following this discussion, the NRC staff and the TRTR members agreed to meet mid-December. The TRTR members agreed to provide marked-up sections of NEI 96-07 to the NRC staff in advance of the December meeting to allow the NRC staff time to review the markups and prepare comments for the December meeting.

The NRC staff then solicited comments from any members of the public in attendance, none were received. The meeting was subsequently adjourned.
