10 CFR 2.206 PETITION REGARDING THE NORTH ANNA POWER STATION (OEDO-20-00469)

Dear Mr. Saporito:

The Nuclear Regulatory Commission (NRC) received your 10 CFR 2.206 Petition dated November 12, 2020 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML20323A162), and initiated the screening process immediately in accordance with Section II.A.2(d) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR

[Code of Federal Regulations] 2.206 Petitions (ADAMS Accession No. ML18296A043). In your petition, you requested that the NRC issue eight Confirmatory Orders (COs) against the North Anna Power Station, Units 1 and 2. The requested COs relate to earthquakes, emergency evacuation, steam generator inspections, reactor vessel inspections, pressure-temperature limits, and rejection of the current subsequent license renewal (SLR) application.

Your petition makes general assertions that in its SLR application, the licensee failed to maintain compliance with 10 CFR Part 50 during extended power operations in relation to earthquakes, fuel storage, and emergency evacuation but does not provide specific shortcomings with respect to North Anna. Your petition makes general assertions in stating that the licensee engaged in guess work and anticipated calculations without due consideration of past reactor trips and previous power uprate operations. In addition, you noted in your petition that the licensee failed to identify the equipment or vendor contracted to perform Charpy tests.

These Charpy test concerns are basically duplicative to concerns you submitted to the NRC in a 10 CFR 2.206 petition related to pressurized water reactors and to Beaver Valley Nuclear Power Station on October 31, 2020 and November 8, 2020 and are currently being evaluated.

Therefore, the NRC staff has screened your request out of the 2.206 Petition Process consistent with MD 8.11 Section II.A.2(d)(ii), General Assertions and Duplicative Requests for Action under 10 CFR 2.206.

The NRC staff has concluded that the concerns expressed in your petition submittal do not warrant immediate enforcement action in accordance with 10 CFR 2.206.
