Thank youfor your letter ofNovember 10, 2020, requestingthat all U.S. Nuclear Regulatory Commission (NRC) employees and officials bereminded oftheir legal obligations concerning the collection,retention, andpreservation ofFederal records andinformation "that is ormaybepotentially responsive toa congressional inquiry, request, investigation, orsubpoena that wasinitiated, continued, orotherwise undertakenduring the116th Congress."

TheNRCtakes itsrecordkeeping responsibilities very seriously. TheNRC's procedures specificallyaddress preserving agency records andinformation relating toanyinvestigations or oversight requests initiatedorconducted byCongress. Further,these procedures prohibit employees from inappropriately destroying oraltering agency records. Additionally, the NRC routinely issues policy reminders toall employees andcontractors oftheir record management andpreservation responsibilities under thelaw. These reminders reiterate the Federal laws and NRCpolicies governing the creation, maintenance, anddisposition ofFederal records, with special emphasis onthe prohibition ofsending orcreating Federal records from nonofficial electronic messaging accounts unless therecords arepromptly forwarded toanofficial account toenable preservation. inaddition, NRCemployees andcontractors arerequired to complete annual training, inaccordance with National Archives andRecords Administration requirements, that describes andexplains these responsibilities.
