SUMMARY

OF SEPTEMBER 22, 2020, PRESUBMITTAL MEETING WITH ENTERGY OPERATIONS, INC., TO DISCUSS A REQUEST FOR A ONE-TIME EXEMPTION FROM 10 CFR PART 50, APPENDIX E, SECTION IV.F.2.C REQUIREMENT FOR OFFSITE PARTICIPATION IN A BIENNIAL EMERGENCY PREPAREDNESS EXERCISE On September 22, 2020, a Category 1 public meeting was held virtually between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Entergy Operations, Inc.

(Entergy, the licensee). The purpose of this pre-submittal meeting was to discuss the licensees plan for submitting a one-time exemption from Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Appendix E, Emergency Planning and Preparedness for Production and Utilization Facilities,Section IV.F.2.c requirement for offsite participation in a biennial emergency preparedness exercise due to the COVID-19 public health emergency. The meeting notice and agenda, dated September 11, 2020, are available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20266G264. A list of attendees is enclosed with this summary.

The licensee presented information (ADAMS Accession No. ML20262H266) regarding its basis for requesting the exemption. The licensee stated in its presentation that several government agencies have requested the postponement of the River Bend 2020 Biennial Graded Exercise due to the public health emergency. The exercise is currently scheduled for December 1, 2020.

The licensee identified its intent to request that the NRC approve the exemption by November 20, 2020, in order to avoid non-compliance with 10 CFR Part 50, Appendix E. The NRC staff clarified that non-compliance would be avoided if the exemption is approved by December 31, 2020, and asked that the exemption request be modified to reflect this timing.

The NRC staff noted that the two examples cited by Entergy in its presentation on Slide 8 titled Other Similar Submittals were for Arkansas Nuclear One, Units 1 and 2 (ADAMS Accession No. ML20195A397), and the Perry Nuclear Power Plant Unit No. 1 (ADAMS Accession No. ML20216A258), dated July 13 and August 3, 2020, respectively. The NRC staff cautioned that these exemption requests were submitted prior to the issuance of subsequent guidance provided to industry on September 2, 2020 (ADAMS Accession No. ML20223A152). The NRC staff also provided some clarification on the expectations for the exemption, such as the inclusion of a statement of reasonable effort by the licensee, and details specific to the coordination local offsite response organizations as outlined in the Office of Nuclear Security and Incident Response (NSIR) Temporary Staff Guidance (TSG) NSIR-2020-01, COVID-19 Related Exemptions From NRC Regulations - Emergency Preparedness Exercises (ADAMS Accession No. ML20196M030).
