Dear Office of Administration:

As a member of the Texas House of Representatives, I am writing to express my strong opposition to the license application to the Nuclear Regulatory Commission (NRC) for the consolidated interim storage of spent nuclear fuel and high-level waste at proposed sites within the state of Texas and within the state of New Mexico, close to the Texas border.

As you have heard from the governors of Texas and New Mexico, local & state elected officials and many others, there are widespread concerns about the proposed Interim Storage Partners (ISP) facilities in Andrews County, Texas and southeastern New Mexico and there is outspoken opposition from diverse parties to the siting of an interim storage facility at either location because of their potential impact on our communities public health & safety and Americas economy & energy security.

As Governor Abbott noted in his letter to President Donald Trump on September 30, 2020 that, Congress began working on a permanent solution to storing nuclear waste with the passage of the Nuclear Waste Policy Act in 1982. Today, 38 years later, there is still no permanent storage solution. The proposed sites in Texas and New Mexico do not provide the deep geologic isolation required for permanent storage in order to minimize the risks of accidents, terrorism, or sabotage, which could disrupt the countrys energy supply with catastrophic effects on the American economy.

The ISP facility that is proposed for west Texas represents a greater radiological risk than is currently authorized for storage and disposal in Texas due to the incredible radioactivity of the nuclear fuel and reactor-related materials that would be stored there. The west Texas site is not capable of safely storing such hazardous waste, while these licenses, if approved, will extend decades into the future. Our state cannot accept such risk.

Texans do not want dangerous radioactive waste which we are not prepared to safely store to be stashed in the Permian Basin Region, one of the most economically important regions to our state and country, nor do we want for it to be transported through our communities via rail infrastructure that was not meant to deliver such deadly cargo.

Out of consideration of the risks that have been expressed to you by local stakeholders, concerned citizens and elected officials, including myself, I urge the NRC to reject the siting of an interim storage facility for these dangerous radioactive materials and respect the states wishes in this matter.
