SUMMARY

OF THE PUBLIC MEETING ON THE USE OF RISK INSIGHTS IN SUPPORT OF 10 CFR 50.59 EVALUATIONS, HELD ON October 8, 2020 On October 8, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a Category 2 public meeting with the Nuclear Energy Institute (NEI) to discuss the use of risk insights in support of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.59 evaluations.

Meeting Summary The NRC staff held a public meeting at NEIs request to continue discussion on the opportunities to use risk insights in the application of 10 CFR 50.59. The NRC staff provided feedback on the NEI information presented at the August 5, 2020 public meeting, where NEI introduced focus areas for revisions to NEI 96-07, Guidelines for 10 CFR 50.59 Implementation, that included: Focus Area #1 - Clarifying the use of more than minimal, and Focus Area #2 - Clarifying the Application of General Design Criteria (GDC) language within NEI 96-07, Guidelines for 10 CFR 50.59 Implementation, Revision 1. The NRC staff also provided an update on the development of Inspection Manual Chapter (IMC) 0335, Changes, tests, and experiments. The staffs presentation slides are documented in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML20282A278).

During the meeting, NEI presented information on Focus Area #3, Methods of Evaluation (ADAMS Accession No. ML20281A252). The presentation included focus area challenges and strategies, and also summaries which incorporated expected future engagement with the NRC staff. NEI concluded their presentation with a revised suggested schedule to work with the NRC staff as they clearly define CONTACT: Tekia V. Govan, NRR/DRO (301) 415-6197

P. McKenna 2 their scope of possible revisions to NEI 96-07 and provide comments on NRCs IMC 0335 as necessary.

Close to 70 participants from the NRC staff, the nuclear industry, and members of the public engaged in dialog with NEI on their proposed approach. The participants asked clarifying questions and provided comments for NEI to consider while developing plans and refining schedules.

The NRC staff did not make any decisions or take any agency positions during this meeting. The enclosure provides the attendance list for this meeting.

Meeting Action Items There were no action items identified during this meeting.

Next Steps and Conclusion NEI indicated that they would like to meet with the NRC staff in November 2020 to receive feedback on the presentation made during this meeting. During such meeting, NEI also plans to address the staffs comments and questions on Focus Areas #1 and #2.

Additionally, the NRC staff intends to present the draft IMC 0335, Changes, Tests, and Experiments.
