Dear Mr. Ayele:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your FOIAonline submission, dated September 21, 2020, in which you appealed the agencys July 28, 2020, response related to your July 24, 2020, Freedom of Information Act (FOIA) request, NRC-2020-000279. You appealed the adequacy of the search performed by the NRC.

Acting on your appeal, I have considered the matter and have determined that there are no records responsive to this request.0F1 Both at the time of the NRCs receipt of your original request, and again upon receipt of your appeal, the Office of the Chief Information Officers (OCIO) FOIA Office performed a search reasonably calculated to locate any records responsive to your request. The two program offices that conducted searches - the Office of International Programs and Office of Nuclear Security and& Incident Response - did not locate any responsive records. Moreover, the FOIA Offices search of ADAMS, the NRCs official record-keeping repository, did not locate any responsive records. Therefore, I have denied your appeal.

This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may seek judicial review of this decision in the district court of the United States in the district in which you reside or have your principal place of business. You may also seek judicial review in the district in which the agencys records are situated or in the District of Columbia.

The 2007 FOIA amendments created the Office of Government Information Services (OGIS) to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation. You may contact OGIS in any of the following ways:

1 As the FOIA Office informed you in its Form 464 response to your request, only one portion of your request asks for records that may be in the possession and control of the NRC; that is, all communications in the form of e-mails and postal correspondence exchanged between employees and legal representatives of the DOJ, the CSB, the DoD, the DoN, the USMC, the DLA, the DHS, the EPA, the NRC, and the UN about George Papadopoulos ties with the state of Israel.
