Dear Mr. Vought:

Section 5 of Executive Order 13950, Combating Race and Sex Stereotyping (September 22, 2020), requires the head of each agency to review its grant programs and, within 60 days, submit a report to the Director of the Office of Management and Budget (OMB) identifying all programs for which the agency may, as a condition of receiving such a grant, require the recipient to certify that it will not use federal funds to promote certain concepts relating to race or sex. Consistent with OMB Memorandum M-20-37, Ending Employee Trainings that Use Divisive Propaganda to Undermine the Principle of Fair and Equal Treatment for All (September 28, 2020), when preparing their reports agencies must look at all federal grant and cooperative-agreement programs, not just those relating to training.

The U.S. Nuclear Regulatory Commission (NRC) has identified its Integrated University Program (IUP) and the NRC Office of Research Financial Assistance Program as grant programs for which the agency may require recipients to certify they will not use federal funds to promote the concepts listed in Section 5 of the Executive Order. Under the IUP, the NRC issues educational grants in the form of scholarships, fellowships, and faculty development awards, as well as research and development grant awards. Under the Office of Research Financial Assistance Program, the NRC issues research and development awards. The Catalog of Federal Domestic Assistance number assigned to the IUP is 77.008, and the number for the Office of Research Financial Assistance Program is 77.009. The NRC has not identified any other grant programs for which the agency may impose the conditions identified in Section 5 of the Executive Order.
