PARTICIPATION IN THE NUCLEAR REGULATORY COMMISSIONS ADVANCE NOTIFICATION PROGRAM
Dear Chairman Wheeler:
Thank you for the Nez Perce Tribes interest in participating in the Nuclear Regulatory Commissions (NRC) Advance Notification Program. This program allows Tribes to receive advance notification of shipments of irradiated reactor fuel and certain other nuclear wastes passing across their reservations. The NRCs regulations require licensees to provide notification of shipments of certain radioactive material to Tribes that have opted to participate in this program, when these shipments will pass through their reservation boundaries.
Per your letter of October 2, 2020, the two designated officials of the Nez Perce government who will be the contacts for the advance notification are: Mr. John Wheaton, Emergency Management Planner as the primary contact and Mr. Jack Bell, Environmental Restoration and Waste Management Director as the back-up contact. The NRC needs the mailing address, phone, and email contact for Mr. Wheaton and Mr. Bell. Please note that:
- a. The names and contact information for Mr. Wheaton and Mr. Bell will be listed on the NRCs public Web site at https://scp.nrc.gov/special/designee.pdf as designees of your government. Licensees obtain up-to-date Tribal government contact information from this Web site to perform their advance notification duties. The Nez Perce Tribe will ensure the accuracy of its information and notify the NRC of any changes needed.
- b. Individuals designated are deemed trustworthy and reliable and have a need to know the information.
Information on shipments is considered Safeguards Information (SGI), which is a special category of sensitive unclassified information that must be protected from unauthorized disclosure. Completion of training in the handling of SGI is required for government representatives who will receive advance notification. The NRC understands that both Mr. Wheaton and Mr. Bell participated in the training on handling SGI that the NRC conducted on September 28, 2020, for members of the Tribal Radioactive Materials Transportation Committee. Participating governments also need to establish procedures for handling SGI and certify to the NRC that these procedures are in place. The attached map shows the Nez Perce Tribes reservation boundaries. Data from the United Stated Geological Survey was used to develop this map. Please confirm the accuracy of this map or let us know if changes are needed. Once the NRC receives the Nez Perce Tribes confirmation of accuracy, the map will be added to the NRC Website, so shippers are aware of the reservation boundaries. Currently, there is not an approved route crossing the Nez Perce reservation. However, the existence of an intersecting route is not a requirement for opting in to participate in the program.
Per your letter, the NRC will coordinate with Mr. Wheaton on obtaining the information requested above to complete the enrollment process in the NRC Advance Notification program for the Nez Perce Tribe.
