Purpose:

To inform the Agreement States that Temporary Instructions TI-001, Implementation of Increased Controls, which described the process used by the U.S. Nuclear Regulatory Commission (NRC) and Agreement State programs to monitor and evaluate actions taken by licensees to implement Increased Controls, and TI-002, Integration of Increased Controls into the Integrated Materials Performance Evaluation Program (IMPEP), which evaluated the implementation of increased controls in NRC and Agreement State Programs through IMPEP, have been rescinded.

Background:

On March 28, 2006, the former Office of NRC State and Tribal Programs1 issued TI-001, Implementation of Increased Controls, which described the process used by the NRC and Agreement State programs to monitor and evaluate actions taken by licensees to implement Increased Controls, and TI-002, Integration of Increased Controls into the Integrated Materials Performance Evaluation Program (IMPEP), which evaluated the implementation of increased controls in NRC and Agreement State Programs through IMPEP. On March 19, 2013, the Commission decided, through the publication of Title 10 of the Code of Federal Regulations (10 CFR) Part 37, to formalize additional security controls associated with Category 1 and 2 licensees.

On April 13, 2012, State Procedure (SA) 104 Reviewing the Common Performance Indicator, Technical Quality of Licensing Actions was issued. On July 14, 2015, SA-101, Reviewing the Common Performance Indicator, Status of Materials Inspection Program and on January 6, 2016 SA-102, Reviewing the Common Performance Indicator, Technical Quality of Inspections were issued. These procedures supersede Temporary Instructions TI-001 and 002 Discussion: The NRC and Agreement State programs have demonstrated successful implementation of increased security requirements for Category 1 and Category 2 radioactive materials into their licensing and inspection programs. For the existing common performance indicators, SA-102 is the final procedure to be revised to integrate and emphasize the evaluation of the programs performance with respect to security of Category 1 and 2 radioactive materials. The issuance of SA-101, SA-102, and SA-104 incorporated all the Part 37 requirements into the IMPEP process and obviates the need for TI-001 and TI-002 which are no longer required or being used in the inspection process. Therefore, TI -001 and TI-002 are rescinded.
