The old procedure SA-117 can be found in the Agencywide Documents Access and Management System (ADAMS) under Accession No.: ML061450220. This letter rescinds the old procedure.

May 14, 2007 ALL AGREEMENT STATES, NEW JERSEY, PENNSYLVANIA, VIRGINIA DISCONTINUATION OF THE AGREEMENT STATE PROJECT OFFICER PROGRAM AND WITHDRAWAL OF STP PROCEDURE SA-117, AGREEMENT STATE PROJECT OFFICERS (ASPO) (FSME-07-044)

Purpose:

To notify the Agreement States that the U.S. Nuclear Regulatory Commission (NRC) has discontinued its Headquarters ASPO Program and withdrawn the Office of State and Tribal Programs (STP) Procedure SA-117, Agreement State Project Officers (ASPO). This letter is for information only. No reply is requested.

Background:

The former STP, now part of the Office of Federal and State Materials and Environmental Management Programs (FSME), used to assign a specific ASPO to each Agreement State. The purpose of the ASPO program was to provide support, including backup support, to the Regional State Agreements Officers (RSAO) and to establish a specific point of contact that would remain knowledgeable about and handle inquiries from assigned States.

Discussion: The creation of FSME prompted an evaluation of the NRCs existing ASPO Program. Former STP staff that had ASPO responsibilities were distributed across several Branches within two Divisions following the reorganization. The distribution of staff into different Branches resulted in new assignments, to align with the new organization. As well, over time, the responsibilities of the ASPO had evolved. For example, ASPOs no longer provide direct backup to the RSAOs. Typically, RSAOs have worked with the other RSAO or the Regional State Liaison Officer (RSLO) in their Region to provide backup and ensure continuous support and effective communications.

To enhance communications regarding the Agreement State issues, not only at NRC Headquarters but with the Regional Offices as well, the NRC is discontinuing the ASPO program, effective immediately. As a result, STP Procedure SA-117 will be rescinded. To provide for continuing communication with NRC Headquarters on Agreement State issues, specific points of contact in the State Agreements and Industrial Safety Branch have been assigned to each of the NRC Regions with radioactive materials responsibilities. These points of contact are assigned responsibility for the entire Region, rather than just individual States.

The points of contact, their contact information, and their assignments are identified in the enclosure.

The assigned individuals in the enclosure will provide a Headquarters point of contact to maintain two-way communications between Headquarters and the Regions regarding Agreement State activities and issues. They will assist the RSAOs in the resolution of issues, as needed, and will provide an alternate point of contact if the RSAO and RSLO are unavailable. Your respective RSAO remains the appropriate first contact when requesting NRC assistance or input on a specific Agreement State issue.

FSME-07-044 2 May 14, 2007 The Headquarters points of contact may also accompany the RSAOs on periodic meetings with Agreement States. The decision will be determined on a case-by-case basis. In some cases, it may be beneficial to appoint another individual with specific expertise in a certain area to accompany the RSAO rather than the assigned point of contact.

This change in policy will not affect those States that are currently pursuing Agreements with the NRC. Your previously appointed Project Manager remains the appropriate Headquarters contact for issues that may arise during the application process.
