CHAIRMAN January 6,2021 TheHonorable Marco Rubio
- Chairman, Committee on Small Business andEntrepreneurship United States Senate Washington, DC20510
DearMr.Chairman:
Onbehalf oftheU.S.Nuclear Regulatory Commission (NRC) andasrequired bythe Small Business Regulatory Enforcement Fairness Actof1996,Iamreporting onthestatus of theagency's provision ofcompliance guides tosmall entities forrules that affect them.
Theagency directs muchofits regulatory activity toNRClicenseesthat arenot considered small entities under thesizestandards in92.810 ofTitle 10oftheCodeofFederal Regulations, "NRCsizestandards."
- However, afewrulesdo have asignificant impact ona substantial number ofsmall entities.
TheNRChasposted acomplete list ofthose rulemakings andtheir corresponding guidance documents ontheagency's Web site at https-//www.nrc.gov/about-nrc/regulatory/rulem.aking/flexibigty-act/small-entities.html.
Since ourlast report onthis matter dated January 9,2020,the NRC has determined that onlyonenewrule hasasignificant impact onasubstantial number ofsmall entities.
Thisfinal
- rule, "Revision ofFeeSchedules; FeeRecovery forFiscal Year2020,"
isanannual rule change that amendsthelicensing, inspection, andannual feesthat theNRCcharges toits applicants andlicensees (85 FR37250;June19,2020).
Thesefeechanges potentially impact the finances oftheNRC'sapplicants andlicensees, whichinclude asubstantial numberof small entities.
