OF AUGUST 31, 2020, MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND OKLO POWER, LLC, TO DISCUSS APPLICABILITY OF REGULATIONS TO THE OKLO AURORA DESIGN (EPID NO.

A virtual meeting was held on August 31, 2020, between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives from Oklo Power, LLC (Oklo) using the Microsoft Teams platform. The meeting was a combination Category 1 public meeting and a non-public meeting. The purpose of the meeting was to provide Oklo the opportunity to present their views on the applicability of NRC regulations on the Oklo Aurora design. The meeting notice, agenda, and meeting slides are located in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession Nos. ML20240A008 (Meeting Notice and Agenda),

ML20239A959 (Oklos Public Presentation Slides) and ML20268A666 (Oklos Non-Public Redacted Presentation Slides).

The NRC staff provided the context for the meeting during the opening remarks. The NRC staff did not make any presentations or provide feedback to Oklo during the meeting.

The Oklo presentation titled, Oklo INC Non-Applicabilities and Requested Exemptions for the Aurora - INL, included Oklos methodology and process for determining applicability of regulations.

The staff noted that the NRC licensing process is flexible. Applicants may request exemptions from regulations on a case-by-case basis depending on the nature of the specific design and independent determination of regulatory applicability.

B. Beasley 2 The NRC staff also acknowledged that some of the existing regulations are focused on light water reactors and NRC anticipates that non-LWR applicants will request exemptions from some of these regulations.

Oklo provided additional insights to specific regulations during the closed portion of the meeting in a presentation titled, Oklo INC Non-Applicabilities & Requested Exemptions for the Aurora INL - Closed Portion. These presentation slides were not sent to NRC in advance of the meeting.

The NRC staff will reflect on the information provided by Oklo and will decide on the next steps (additional meetings, audits, and/or Requests for Additional Information) to further engage with Oklo on this Step 1 - Review licensing topic.
