Items of Interest Week Ending SEPTEMBER 4, 2020 Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Items of Interest Week Ending SEPTEMBER 4, 2020 NMSS Staff Hold Public Meeting on Retrospective Review of Administrative Requirements On August 27, 2020, the U.S. Nuclear Regulatory Commission (NRC) NMSS staff held a Category 3 public meeting on the retrospective review of administrative requirements initiative.

Attendees discussed stakeholder input on outdated or duplicative administrative requirements that could be potentially modified or eliminated. The staff is finalizing the review of stakeholder and staff input and will begin to develop a set of recommendations for Commission review.

NMSS Staff Hold Public Meeting on Environmental Impact Statement On September 2, 2020, the NMSS staff held its sixth and final public meeting via webinar and teleconference on the draft environmental impact statement for the Holtec International proposed consolidated interim storage facility in Lea County, New Mexico. The public meeting lasted 3.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br /> and approximately 130 individuals participated with 27 people providing verbal comments. Several commenters requested that in-person public meetings be held after the COVID-19 public health emergency has ended. The public comment period ends September 22, 2020.

Public Protective Actions During a General Emergency: Petition for Rulemaking (PRM);

Notice of Docketing and Request for Comment; Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) (Docket No. PRM-50-123; NRC-2020-0155)

On August 31, 2020, the NRC published a notice of docketing and request for comment in the Federal Register (85 FR 53690) for a petition for rulemaking from Thomas McKenna dated June 1, 2020. The petitioner requested that the NRC revise its regulations so that protective actions implemented during a General Emergency at a nuclear power plant will most likely do more good than harm when the possible physical health effects of radiation exposure and protective actions are taken into consideration. The petition was docketed by the NRC on June 24, 2020, and has been assigned Docket No. PRM-50-123. The NRC is examining the issues raised in PRM-50-123 to determine whether they should be considered in rulemaking.

On September 3, 2020, the NRC published a notice in the Federal Register (85 FR 54885) confirming the effective date of September 14, 2020, for the direct final rule that was published in the Federal Register on June 30, 2020 (85 FR 39049). This direct final rule amends the NRCs spent fuel storage regulations by revising the TN Americas LLC, Standardized NUHOMS Horizontal Modular Storage System listing within the List of approved spent fuel storage casks to include Renewed Amendment No. 16 to Certificate of Compliance No. 1004.

The effective date of September 14, 2020, for the direct final rule published June 30, 2020, is confirmed.
