Status of Petition for Rulemaking: Access to the Decommissioning Trust Fund for the Disposal of Large Components (PRM-50-119; NRC-2019-0083)

Dear Mr. Van Noordennen,

I am writing to provide you with an update on the February 22, 2019, petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory Commission (NRC) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19079A293). On March 20, 2019, the NRC docketed your petition pursuant to § 2.803 of Title 10 of the Code of Federal Regulations (10 CFR), "Petition for rulemaking NRC action," and assigned it Docket No. PRM-50-119. Please reference this docket number on any correspondence you may have concerning the petition. On June 12, 2019, the NRC published a notice of docketing and a request for comment for your petition (84 FR 27209). The comment period closed on August 26, 2019.

In your petition, you requested the NRC to amend 10 CFR Part 50 to revise the definition of decommissioning in § 50.2, Definitions, and amend § 50.82, Termination of license, to allow access to the decommissioning trust fund for the removal of major radioactive components before the permanent cessation of operations at nuclear power plants.

The NRC is reviewing your petition and the public comments received in response to the June 12, 2019, Federal Register notice. The Commission makes the final decision on the NRCs actions on petitions for rulemaking. After reviewing the merits of your petition and the public comments, the NRC staff prepares a recommendation to the Commission and the Commission will then make and issue its decision.
