NUCLEAR REGULATORY COMMISSION WA8HINGTON. D.C. 20665 0001 June 26, 1998 Mr. Jack Allen General Plant Manager Westinghouse Electric Corporation Commercial Nuclear Fuel Division P.O. Drawer R Columbia, S.C. 29250

SUBJECT:

NRC INSPECTION OF THE NUCLEAR CRITICALITY SAFETY CORRECTIVE ACTION PROGRAM - INSPECTION REPORT 70-1151/98-202 AND NOTICE OF VIOLATION

Dear Mr. Allen:

This refers to the Nuclear Criticality Safety (NCS) inspection conducted on April 27 - May 1, 1998, at your Columbia, South Carolina facility. The purpose of the inspection was to review your progress involving near-and long-term improvements in your NCS program and to determine whether activities authorized by your license were conducted safely and in accordance with Nuclear Regulatory Commission (NRC) requirements. At the conclusion of the inspection, 1

the findings were discussed with those members of your staffidentified in the report.

Within the areas examined, the inspection consisted of selective examinations of procedures and representative records, interviews with plant personnel, and walkdowns of selected plant activities. During the inspection, one violation of NRC requirements was identified as well as several weaknesses in the NCS corrective action plan implementation. The violation involved the operation of process equipment with an inoperable criticality safety control. The violation is of concern to the NRC because the inoperability of the control was not recognized until the condition was identified by the NRC inspectors. In addition, it raises concern over the assumptions expressed to the NRC during the pre-decisional enforcement conference concerning the interim safety of plant operations during the time that NCS corrective actions are being implemented.

As such, au are required to respond to the enclosed Notice of Violation (Notice) and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions planned to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
