Dear Mr. Bowling:

SUBJECT: NRC COMBINED INSPECTION 50-245/98-207:50-336/98-207:50-423/98-

207 and NOTICE OF VIOLATION

Between March 1 - April 27,1998, the NRC performed an inspection at Millstone Units 1,

2 & 3 reactor facilities. The results of the inspection were discussed at an exit meeting on

May 1,'1998: The enclosed report presents those results.

During the 8-week period covered by this inspection period, your conduct of activities at

the Millstone facilities was generally characterized by safety-conscious operations,

practices, and careful radiological work controls. We are concerned, however, about seven

violations of NRC requirements that were identified. In the first instance, NRC inspectors

identified the failure to establish measures to ensure the Unit 1 gas turbine generator fuel

oil conformed to procurement documents.

In five instances at Unit 2, inspectors identified the failure to establish procedures for

draining safety-related systems, as required by technical specifications; the failure to

measure instrument minimum accuracies for wind speed channels as part of the

meteorological monitoring program, as required by technical specifications; the failure to

test four digital liquid and gaseous effluent radiation monitors in a manner consistent with

' the technical specification definition for a Channel Functional Test; the failure to

adequately implement a reactor building closed cooling water (RBCCW) system operating

procedure, in that an RBCCW valve was placed in service before operability of the valve

was established through post-maintenance testing, which contributed to the temporary

loss of the RBCCW system; and an instance in which a proposed revision to the final

safety analysis report provided in your September 3,1997, submittal contained incomplete

information regarding your ability to replenish fuel oil to the supply tanks for the emergency

diesel generators,

in the final instance at Unit 3, inspectors identified a failure to ensure that degraded or

nonconforming parts were promptly identified and corrected in the area of nonsafety-

related parts upgrade as part of the material, equipment, and parts lists (MEPL) program.

These violations are cited in the enclosed Notice of Violation, and the circumstances

surrounding the violations are described in detailin the enclosed report. Please note that

enclosed Notice when preparing your response. The NRC will ur:e your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements.

At Unit 2, several previous reports, including the cover letter for NRC !nspection Report 50-

336/97-208, highlighted the concern that you have not yet fully developed broader

corrective actions to address past instances where nonsafety-related (NSR) components

and parts were inappropriately installed in safety-related systems (i.e., for parts that were

classified as " Undetermined" or "NSR" and had no MEPL evaluations). During this

inspection period, the NRC found that you have still not approved an acceptable plan to

address this concern. Therefore, at the exit meeting held on May 1,1998, Unit 2

management committed to provide to the NRC by May 15,1998, a letter describing your

plan for dispositioning these MEPL concerns. We have received your letter dated

Ma'/14,1998, and will evaluate your response in a future inspection.

At Unit 3, ten significant items list (SIL) issues were closed during this period, as

documented in the attached inspection report. Of the Sllitems remaining open, the MEPL

issue remains somewhat problematic, as identified above with respect to the Unit 3

violation and other MEPL corrective actions which are continuing. In response to the noted

Unit 3 violation, we request that you also apprise us of your plan and schedule to bring all

degraded / nonconforming items (i.e., not only the 29 components identified in the NOV, but

also those items of similar concern found during your continuing reviews) into full

compliance with 10 CFR 50, Appendix B requirements, in accordance with the guidance

provided in Generic Letter 91-16, Revision 1. Additionally, with regard to some closed SIL

i

issues, we note that your updated response to Generic Letter 89-13 (SIL item 36)is being

. reviewed by the Office of NRR and an unreviewed safety question associated with a 1986

modification of the recirculation spray system (related to SIL item 85) is also under NRR

review. ' As appropriate, we intend to conduct inspection follow-up of a sample of your

programmatic activities that address further commitments in these areas. While the overall

inspection and closure of SIL issues is progressing well, your attention to address the

remaining open items, respond to NRC follow-up questions, and complete committed

corrective actions merits continued management emphasis.

Within the area of plant support, we found that you continued to implement effective

radiological environmental monitoring and meteorological monitoring programs. Your

contract environmentallaboratory for sample analyses and quality assurance / quality control

continued to demonstrate excellence in laboratory practices. You conducted thorough

quality assurance audits of the REMP and MMP. The Production Operations Services

Laboratory demonstrated good performance regarding maintenance and calibration of the

meteorological instrumentation.
