Dear Mr. Rael:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the Maybell, Colorado, Long-term Surviell.snce Plan (LTSP), Revision 0, dated December 1997, which was subrnitic f by U.S. Department of Energy (DOE) letter dated January 23,1998. The DOE transmittal letter stales that the LTSP is not complete, and that the missing material will be provided by DOE upon completion of the remedial action.
Since Revison 0 of the LTSP is incomplate, the NRC staf" review was, of necessity, 'imited in scope, and a review to ertablish acceptance of the LTSP will be performed after submittal of the final LTSP. The staff's comments on Revision 0 of the LTSP are enclosed for your information, and these comments should be addressed in DOE's submittal of the final LTSP.

e COlylMENTS ON MAYBELL LONG-TERM SURVIELLANCE PLAN, REVISION 0 Backaround The Maybell mill and tailings site is located about 5 miles northeast of the town of Maybell and about 25 miles west of the town cf Craig in Moffat County in northwestem Color wo.
The mill was established in 1955-56, and operated until 1964. Surface remediation nas l
begun in April 1995. The site is being remediated by the U.S. Department of Energy un ter Title I of the Uranium Mill Tailing Radiation Control Act.
Since Revision 0 of the Long-term Surviellance Plan (LTSP), dated December 199E is incomplete, the NRC staff review was limited in scope, and a review to establish accepta me of the LTSP will be performed after submittal of the final LTSP. The staff's comments to Revision 0 should be addressed in DOE's submittal of the final LTSP.
Geotechnical
- 1. A north arrow should be shown on Figure 2.2 which shows the plan of the disposal cell.
EL 6200 and EL6300 contours should be shown in the northeast vicinity of Johnson Wash and Route 40.
- 2. The calculated settlement at the nine settlement plates should be included in Section 3.5.2. This will assist the DOE inspectors in assessing the relevance of the monitored data to the estimated settlement and to judge if consolidation has taken place.
- 3. The suspected location of the stimo pocket mentioned in Section 3.5.3 should be shown on the site plan to assist the DOE inspectors in looking for seepage.
Groundwater Hydroloay 4.
DOE should incorporate the monitoring plan and monitoring results discussions of Section 2.0, Water Level Monitoring, Appendix A of the LTSP !nto Section 2.6.1, Surface Remediation (Subpart A) of the LTSP. The decision flow chart, Figure 2 of LTSP Appendix A, should also be moved to Section 2.6.1. Making the modifications should remove any potential future confusion ebout what monitoring will be performed and what courses of action should be taken to evaluate any potential deviations from the anticipated responses.
- 5. Figure 2 in LTSP Appendix A shows that monitoring wells will be abandoned if trend analysis indicates a level or downward (water level) trend for three years. The NRC staff considers that a three year monitoring period is too short given the anticipated duration of transient drainage from the disposal cell. DOE should revise the LTSP to include a monitoring period long enough to adequately verify the modeling predictions of transient drainage from the disposal cell, and state that termination of the monitoring program and abandonment of the monitoring wells wi!, not be undertaken without NRC cpproval.

- 6. Should the reference to DOE Order 5700.6C, Quality Assurance,21 August 1991, under Section 7.0, References, be revised to 10 CFR Part 830?
