This ref ers to your December 29 1997, response to the Notice of Violation (NOVs) and the s

Notice of Deviation (NOD) transmitted to you by our letter dated November 28,1997, with Inspection Report 70-7001/97-208. We have examined your response and found that it meets the requirements of 10 CFR 2.201. We will examine the implementation of your corrective actions during future inspections.

In your response, you denied the deviation 97-208-01. Your denial to the deviation was on the basis that "There is no requirement to obtain NRC concurrence for a change to a commitment of the type referenced in the NOD." You further indicated that your commitment revision process is based on the Nuclear Energy Institute's Guidance Document," Guideline for Managing NRC Commitments" which has been endorsed by the NRC and which allows the licensee to proceed with a change if the NRC is " . . . as soon as practicable after the change is approved by licensee management, but before any committed completion date."

Based on your response of December 29,1997, we have concluded that the findings issued in the inspection Report 97-208 were valid and occurred as stated. We agree, however, that there was no requirement to obtain NRC concurrence prior to changing the subject commitment. /

Accordingly, the deviation is hereby rescinded. In this case, your representations in your letter of p December 29,1997, will be taken as your commitments to resolve the deficiency.
