REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE OF WESTINGHOUSE AP600 TEST PROGRAM ADS PHASE B1 TEST ANALYSIS REPORT
Dear Mr. McIntyre:
By Westinghouse letter NSD NRC-98-5662, dated April 7,1998, you submitted the "AP600 TEST PROGRAM ADS PHASE B1 TEST ANALYSIS REPORT " WCAP-14305 (Revision 3). The report evaluates the single-phase flow resistance of the ADS valve and pip;ng package, along with the effective flow area of the ADS valve and piping components (for choked flow) and two-phase flow multipliers. Similarly, by Westinghouse letter NSD-NRC-98-5587, dated February 7,1998, you submitted revisio12 of this report, and by Westinghouse letter NTD-NRC-95-4491, dated June 23,1995, you submitted revision 1 of this report..
In all three letters, you stated that certain information in WCAP-14305 was considered proprietary and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. The non-proprietary version of this report was submitted as WCAP-14306 in Westinghouse letters NSD-NRC-97-5662, dated April 7,1998, for placement into the Public Document Room. Affidavit AW-98-1227 dated April 8,1998, Affidavit AW-98-1215 dated February 27,1998, and Affidavit AW 95-850, dated June 26,1995, were all executed by you and pertain to revisions 3,2 and 1 of WCAP-14305 respectively. Each Affidavit claims, in part, that the information in WCAP-14305 is classified as proprietary because "The development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money. in addition, the affidavits also state that this information should be considered exempt from mandatory public disclosure for the following reasons:
- a.. The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.
b.
It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.
