REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE OF WESTINGHOUSE AP600 ACCIDENT ANALYSES - EVALUATION MODELS REPORT
Dear Mr. McIntyre:
I Gy Westinghouse letter NSD-NRC-97-5232, dated July 14,1997, you submitted the "AP600 ACCIDENT ANALYSES - EVALUATION MODELS," WCAP-14601 (Revision 1). The report discusses the evaluation models and parameters used in the AP600 Accident Analyses completed for design certification. Similarly, by Westinghouse letter, NSD-NRC-96-4664, dated March 20,1996, you submitted revision 0 of this report.
In both letters you stated that certain information in WCAP-14601 is considered proprietary and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. The non-proprietary version of the AP600 accident analyses - evaluation models report (WCAP-14942) was enclosed with Westinghouse letter NSD-NRC-97-5286 dated August 21,1997, for 4
placement into the Public Document Room. Affidavits AW-97-1136 dated July 15,1997, and AW-96-945 dated March 20,1996, were both executed by you and claim, in part, that the information is classified as proprietary because "The development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money." In addition, the affidavits also state that this information should be considered exempt from mandatory public
- sclosure for the following reasons:
a.
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over i
other companies.
c.
Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
