REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR WESTINGHOUSE AP600 DESIGN LETTER OF JANUARY 17,1994
Dear Mr. McIntyre:
By Westinghouse letter NTD-NRC-94-4041 dated January 17,1994, you submitted information in response to a staff request for additionalinformation regarding the instrumentation and control system.
In your letter, you identify the information that is considered to be proprietary and request that it be withheld from public disclosure in accordance with 10 CFR 2.790. The enclosed affidavit (AW-94-569), executed by you on January 17,1994, states that the designated information, owned and held in confidence by Westinghouse, should be considered exempt from mandatory public disclosure for sevr al reasons including tha following:
(a) The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc ) where prevention of its use by any of Westinghouse's competitors without
!icense from Westinghouse constitutes a competitive tsconomic advantage over otner companies.
(b) It consists of supportinD data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.
(c) Its use by a competitor would reduce his expenditure of resources or improve his competi-tive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
We have reviewed your submittal and the materialin accordance with the requirements of 10 CFR 2.700 and, on the basis of Westinghouse's statements, have determined that the submitted information sought to be withheld does not contain trade secrets or proprietary commercial information. Specifically, the material is similar to the material that exists in the current non-proprietary revision of the standard safety analysis report for the AP600. In addition, the material was useo by the staff in the developrnent of the draft safety evaluation report for the AP600, and 'herefore, it should remain on the docket.
