Dear Mr. Ortiz:
The Environment Department of the State of New Mexico relinquished its authority to conduct sealed source and device evaluations earlier this year and transferred this function to the U.S.
Nuclear Regulatory Commission. With the transfer, the State of New Mexico had sent to NRC the following registration certificates of alpha calibration sources manufactured by The Source, Inc.:

Specifically, Section 5.1.1, " Calibration and Reference Standards," NUREG-1556, Vol. 3 states that calibration and reference sources may be licensed without evaluation review if the sources do not exceed 10 pCi (0.37 MBq) for alpha emmitting material. Therefore, NRC registration for these sources is not required. However, we request that you inform NRC about any changes in activity levels of these sources that you may make or about the marketing of any new sources that you may develop in the future. I called The Source, Inc. regarding the transfer of their i certificates from the State of New Mexico to NRC.
SUMMARY
Ch. Gonzales and M. Ortiz are the partners for the company.
Mike Ortiz explained that they deal only with limited quantities: less than 10 Ci for a emitters, less than 100 pCi for # and y emitters.
These activities are exempt quantities per 10 CFR 30.
Therefore, he does not need certificates from NRC. He also added that they have attended the NRC's sealed source certification seminar and that he had discussed this issue with S. Baggett a number of years earlier.
ACTION REQUIRED:
NRC is to (1) confirm the statement that the quantities are exempt; (2) close out or continue the case reviews depending on exemption.
