Dear Mr. McGregor:
This is in reference to your affidavit dated September 25,1997, in which MDS Nordion, Inc.
requested that 13 drawings which you had sent to NRC be withheld from public disclosure pursuant to 10 CFR 2.790. We reviewed these diawings and determined that 11 of the 13 are not needed for amending MDS Nordion's registration certificates of sealed sources and devices.
However, two of the 13 drawings, Drawing No. C103203-098/ Issue D' and Drawing No.
SA61600/ Issue A, are needed to amend the registration certificate of your Model Gammacell 3000 irradiator.
Section 2.790(b)(1) of 10 CFR Part 2 requires that each supporting application be accompanied by an affidavit that contains a full statement of the reasons on the basis of which it is claimed that the information should be withheld from public disclosure. The section further states that the Commission will consider whether the information is of a type customarily held in confidence by the applicant.
The two drawings, referenced above, of your application has been reviewed in light of the aforementioned paragraphs of the regulations. It was found that your application indicated disclosure of the information in the drawings would cause irreparable harm to MDS Nordion, Inc.; and would enable third parties to use the information to implement improvement on their sources / units without incurring any development cost, thus compromising MDS Nordion Inc.'s ability to compete in the market place. We determined that the information in the drawings is minimal and general. Specifically, the drawings contained three dimensions each for the Model C-3000 Source Assembly and the Assembly of Cell R6160 Capsule respectively, indicating maximum or reference values. Dimensions, specified similarly to yours, are part of practically all applications that NRC receives and approves for sealed sources and devices without proprietary claims. Accordirigly, consideration should be given to supplementing the present record with additional factual information that provides justification for withholding the j
' information from public disclosure.
In summary, we have determined that the two drawings of your application, referenced above, are not in conformity with 10 CFR 2.790(b). Consequently, we are unable to conclude at this time that the information referenced in the application is proprietary.
