50-423/97-83 AND NOTICE OF VIOLATION
Dear Mr. Bowling:
LThis letter transmits the report of the U.S. Nuclear Regulatory Commission (NRC)
Operational Safety Team inspection (OSTI), conducted from April 13-24,1998, of activities
authorized by NRC operating license NPF-49, at your Millstone Unit 3 facility.
On May 5,
1998, the Team findings were discussed with you and members of your staff at an
inspection exit meeting that was open for observation by members of the public.
The OSTI performed an independent, broad scope assessment of management controls,
administrative programs, equipment and personnel and their readiness to support restart
and safe operation of the Millstone Unit 3 facility. The OSTI evaluated the areas of
Management Programs; independent Oversight; Operations; Engineering; and Maintenance
and Surveillance. Within these areas, the inspection consisted of selective examinations of
documents, direct observation of plant equipment and activities, and interviews with plant
staff.
The team noted that significant progress had been made in enhancing overall station
performance. In particular, the team observed management involvement in directing plant
activities; an intrusive and independent Quality Assurance organization; an improved
corrective actions program; and an effective self assessment process. However, two
'
issues were identified by the team that require corrective action prior to plant restart.
. These issues include the implementation of corrective actions for the operational events
that ' occurred during plant heatup and verification that the valve and system alignment
program has been effectively implemented. We will inspect your implementation of the -
.
corrective actions for these issues before restart. Both these issues are the subject of
Notices of Violation that are included as an Enclosure to this letter.
Based on the observations documented in the attached inspection report, the team has
concluded that, pending the completion of the restart issues identified in your tracking
systems and by the OSTI, the plant equipment, staff, management, programs and
processes are in place to support a safe restart and continued operation of Millstone
Unit 3.

The violations are cited in the enclosed Notice of Violation, and the circumstances
surrounding the violations are described in detail in the enclosed report. Please note that
you are required to respond to this letter and should follow the instructions specified in the
enclosed Notice when preparing your response. The NRC will use your response, in part,
to determine whether further enforcement action is necessary to ensure compliance with
regulatory requirements.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter
and its enclosures will be placed in the NRC Public Document Room (PDR).
