I;ebruary 19,1998 MEMORANDUM AND ORDER I

A The Commission grants a monon filed jointly by the NRC Staff and the Licensee for termination of a Confirmatory Order proceedng initiated by the Ucensee. De Ucensee had requested a heanng on C

the Order, which nunhfied the license to reqwre that the Ucensee devek)p and implement certain wntren f

procedures, and develop, and subnut for NRC approval, traimag and aust plans. The joint monon was

~

eled following a seulerrent agreement reached by the Ucensee and tne NRC Staff (and approved by the Ucensmg Dourd) in a related civil penalty proceeding, which was also imtiated by the Ucensee.

D The Commisuon finds that the fundamental issue is the same in bodi proceedings; whether certain con &uens in the license issued to 21st Century Tecimologies are jusuhed on health and safety grounds.

1 The Comnussion therefore concludes that good cause exists to ternunate the Conhrnuitory Order procee&ng l

in view of the approved settlenunt and terniinanon of the civil penalty procce&ng. for this reason, and because the terms of the Settlement Agreerrent suggest that the Staff and the Licenace will be able to teach

mutually agreeable hcense terms, the Conmussion dechnes to undertake sua sponse review of the Ucensing 7y Board's approval of that agreement.

February 11,1998; DIRECTOR'S DECISION UNDER IP C.F R. I 2.206 A

By a peouon dated March 3,1997, subnuned by Albert A. Cizek (ftutioner), Peutioner requested that the bcennes of the three Millstone nuclear reactors and the Haldam Neck nuclear reactor held by Northeast U6 hues (NU or Ucensee) be mosued by placing certain con & dons on the operating licenses f

of each of these facilities. 'Dr conditions would call for autornauc and specine enforcerrent sanctions

' f boed upon the occun'ence of certain violations or events. Iturioner alleged that the hcense constions I

were warranted bmed on the Ucensee's pour past perforrtuuice inclu&ng knowmg, willful, and reckless i

past violations of NRC requirements.

B The Duector of ttr Othee of Nuclear Reactor Regulacon issued a Director's Decision on itbruary 3

11 1998. concluding that the peudon contained no informanon of which the NRC was not already aware and denying Petinoner's request for specific enforcenrnt related license constions. The Duector concluded that x

a mechamstic enforcement approach is neither necessary nor appropriate to ensure regulatory compliance at

/C the Millstone and Ha& lam Neck facihues. Estensive efforts hase been and are being taken by the Ucensee 7-to ensure that future operanon of the Millstone umts and the decommissioning of the !!aldam Neck facihty
