Seabrook Station Supplemental Petition of Great Bay Power Corporation for a Determination of Reasonable Assurance of Decommissioning Funding

' North Atlantic Energy Service Corporation (North. Atlantic) encloses, as Enclosure 1 to this letter, Great Bay Power Corporation's (Great Bay) Supplemental Petition for a Determination of Reasonable Assurance of Decommissioning Funding. This supplemental petition is based upon recent action taken by the State of New Hampshire to pass legislation that imposes proportional guarantor status on the other owners of Seabrook Station.should Great Bay default on its decommissioning obligation.

On January 30,1998, North Atlantic submitted a request to the NRC on behalf of one its owners and licensees, Great Bay' for a determination from the Commission that Great Bay's proposal to accelerate its decommissioning trust fund payments would provide reasonable assurance of decommissioning funding, or, in the attemative, would merit a permanent exemption from i

10 CFR 50.75.

l Currently, Great Bay has a temporary exemption from the requirements of 10 CFR 50.75(e)(2) for the earlier of one year or 90 days after the effective date of pertinent changes to 10 CFR 50.2 and 10 CFR 50.75. This temporary exemption was granted by the Commission on July 23,- 1997.

.- U.S. Nuclear Regulatory Commission NYN-98086/Page 2 The attached supplemental petition _ asks the Commission to find that the enactment oflegislation by the State of New Hampshire that makes the'other owners of Seabrook Station - proportional guarantors of Great Bay's decommissioning obligation in the event of a default provides the reasonable assurance of decommissioning funding called for in 10 CFR 50.75. That legislation, entitled Senate Bill 140, was' signed into law by the Governor of New Hampshire on June 11,1998.
