RANDALL L. HERRING Attached is a request for hearing dated June 7,1998, submitted by Randall L. Herring (Docket No. 55-22234). The hearing request is in response to a letter from the NRC staff dated May 18,1999 (copy a%ched), sustaining a denial of Mr. Herring's reactor operator's license application.
Mr. Herring's request for hearing is being referred to you for appropriate action in accordance with 10 C.F.R. Sec. 2.1261.

Docket No. 55-22234 Proposed Licease Denial in response to the letter of May 18,1998 (attached) austaining the proposed denial of license, I am requesting a hearing in accordance with 10 CFR2.103(b)(2). I disagree with the "NRC Analysis and Conclusion" on Contentions 3 and 4 as discussed in the letter of May 18,1998, and I do not accept the proposed denial.

Dear Mr. Herring:
In response to your letter of February 11,1998, the staff of the U.S. Nuclear R Commission (NRC) has reconsidered the proposed denial issued to you on and reviewed she grading of the operating test administered to you during the period December 2 - 5 and December 16 -18,1997, in light of the information you provi finds that you did not pass the operating test. The results of our review are enclosed.
Consequently, the proposed denial of your license application is sustained. if y proposed denial and decline to request a hearing within 2u days as discussed below, proposed denial will become a final denial. You may then reapply for a license in accorda with Title 10, Section 55.35, of the Code of FederalRegulations (10 CFR 55.35), s following conditions:
Because you passed a written examination on December 12,1997, you may !
a.
waiver of that portion. This waiver will be granted by the NRC and will be valid year from your examination date, b.
Because you did not pass the operating test administered to you on December 2 -
December 16 - 18,1997, you will be required to retake an operating test.
You may reapply for a license two months from the date of this letter.
c.
If you do not accept the proposed denial, you may, within 20 days of the date of thi recsast a hearing in accordance with 10 CFR 2.103(b)(2). Submit your request in writin Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington with a copy to the Assistant General Counsel for Hearings and Enforcement, Office of th General Counsel, at the same address.
