NOTICE OF VIOLATION Radiation Consulting Associates. Inc. Docket No. 150-00009

' Hialeah Gardens. Florida License No General License EA 98-007 During an NRC inspection conducted on March 17, 1997 violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions." NUREG-1600, the violations are listed below:

A. 10 CFR 30.3 requires, in relevant part. that no person shall possess or use byproduct material except as authorized by a specific or general license issued by the NRC.

10 CFR 150.20(a) provides, in part, that any person who holds a specific license from an Agreement State is granted an NRC general license to conduct the same activity in non-Agreement States subject to the provisions of 10 CFR 150.20(b).

Items 9.A-H of Florida License No. 677-1. issued to Radiation Consulting Associates. Inc. (RCAI), authorized in part, the possession and use of licensed radioactive materials incident to the analysis of sealed source leak tests and contamination samples, for the calibration of radiation survey instruments, and for storage only.

Contrary to the above, on December 28. 1996. RCAI. conducted activities in a non-Agreement State, an area of NRC jurisdiction, that were beyond the limitations of its State of Florida license and not licensed by the NRC. Specifically. RCAI removed a fixed gauging device from service at a facility located in Minneapolis Minnesota, an activity not authorized on RCAI's license or authorized by the NRC, through general or specific licensing.

This is a Severity Level IV violation (Supplement VI).

B. 10 CFR 30.3 requires, in relevant part, that no person shall possess or )

use byproduct material except as authorized by a specific or general <

license issued by the NRC.  ;

10 CFR 150.20(b)(1) requires, in part, that any person engaging in ,

activities in non-Agreement States shall, at least three days before 1 engaging in each activity, file four copies of NRC Form-241. " Report of Proposed Activities in non-Agreement States." with the Regional Administrator of the appropriate NRC Regional Office.
