Appendix A The Robert Irsay Company Docket No.: 99900742 NOTICE OF N0HCONFORMANCE During an inspection conducted on January 23-27, 1989, the implementation of your Quality Assurance (QA) program at Skokie, Illinois and at the Quad Cities nuclear power plant site office was reviewed. The results of the inspection revealed that certain of your activities were not conducted in accordance with NRC requirements. These items are set forth below and have been classified as nonconformanccs with the requirements of Appendix B to 10 CFR 50.

Criterion X of 10 CFR 50, Appendix B states in part, "A program for inspection of activities affecting quality shall be executed...to verify conformance with the documented instructions, procedures, and drawings for accomplishing the activity...."

Subsection 11.4 of Section 11 of The Robert Irsay Company)(RICO) quality assurance manual states in pert, "The Quality Control (QC Technician will perform a visual inspection of the production item and verify (acceptableFab ticke completion of work in accordance with the fabrication ticket and duct brochure. This inspection shall include physical dimension, stiffener size, welding and workmanship, as well as identification of welders and material on the Fab ticket.

If the inspection shows all attributes to be acceptable, the QC Technician shall sign the Fab ticket and inspection report to signify acceptability.... Only accepted pieces may be shipped to the site...."

Contrary to the above, RICO shipped ductwork to the Dresden and Quad Cities Nuclear Power Plants with 3/16-inch by 2-inch welds attaching stiffeners to ducts which were spaced more than 8 inches apart. The relevant design drawings require welds spaced at 8-inch intervals maximum (89-01-01).

Criterion XVI of Appendix B to 10 CFR 50 states, in part, that "Heasures shall be established to assure that conditions adverse to quality, such as failures..., and nonconformances are promptly identified and corrected.

In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition. The identification of the significant condition adverse to quality, the cause of the condition and the corrective action taken shall be documented and reported to appropriate levels of management."

Contrary to the above, measures are not established in the current RIC0 quality assurance manual to adequately address corrective action to be taken on adverse findings identified by their customers during their audits.

Furthermore, the program does not include an approved procedure to adequately correct nonconformances and provide assurance that actions l

performed by a customer on RIC0 on March 30, 1987 resulted in a finding related to personnel performing internal audits'at RIC0, no corrective action was taken. A subsequent customer audit on December 7 and 8, 1988 resulted in an identical finding in the same area, yet there was no provision in the QA manual which required corrective action to preclude recurrence (89-01-02).
