Dear Mr. Erickson:
Thank you for your letter of February 9,1998, responding to our review of the final Washington 10 CFR Part 20 equivalent regulation. In our letter to you of December 18,1997, we identified a compatibility concern between 10 CFR 20.1301(c), which is presently a compatibility Category A, and WAC 246-221-060. In your letter of February 9,1998, you requested that we re-evaluate the designation of 20.1301(c) and consider changing it to a Category C.
While we believe the rationale discussed in your letter has merit, any changes to the compatibility or health and safety designation for specific rules must be made in consideration of the views and comments of other Agreement States as well. The staff will consider your request during the upcoming revisions to the B.7 Procedure, " Compatibility Categories and Health and Safety identification for NRC Regulations and Other Program Elements." The staff plans to re-evaluate some of the designations in the B.7 Procedure over the next two months. When that effort is completed, the proposed revised B.7 Procedure will be disserninated to the Agreement States for review and comment. After the review and comment period is completed, staff will issue a revision to the B.7 Procedure. Therefore, we will defer a compatibility and ht:alth safety finding on the Washington equivalent of 10 CFR Part 20 until this effort is completed.
