APPLICANTS' RESPONSE TO INTERVENERS' MOTION FOR RECONSIDERATION In~another burst of creativity the Attorney General of The Commonwealth of Massachusetts (MAG) has filed a Motion for Reconsideration of the Board's Memorandum and Order of u
deptember 26, 1989 ("The Motion").
The Motion is unenlightening as to any new matter or facts that warrant reconsideration and have come to light since the time of the original filings to which the Memorandum and Order was directed.
Nor are we' advised as to why the arguments and comments made in the motion were incapable of earlier elucidation.
In'any event, any motion for reconsideration is basically addressed to the. sound discretion of the tribunal before which it is made.
It is the Applicants' view that MAG
.has been repeatedly. accommodated in his " hip-shooting" filing n:conum.sn 8910180030 091004 PDR ADOCK 05000443

tactics in this proceeding and that neither fairness, nor the sound exercise of discretion, dictates that he be 1
accommodated once again.
The Motion should be denied.
