Commissioner Diaz's Comments on SECY 98-038 1 approve the staff's interpretation and plans to inform DOE pursuant to the January 29,1997 Memorandum of Understanding of the inconsistencies between NRC's regulatory approach and that currently proposed by DOE's contractor for the Co-located Worker standards. Since the extent of the inconsistencies still needs to be determined, the staff should incorporate in the letter to DOE that a risk informed approach may assist DOE in evaluating the adequacy of the contractor submittals l
