Dear Judges,
This is to advise you that one of the additional reasons that Interveners listed in their Motion for Extension of Time and Motion for Revision of Hearing Schedule should no longer be considered by the Board.
Interveners' concern that their Director, Joette Lorion, would have to resign from her position with the Center if chosen for the Florida Public Service Commission' (PSC) position is no longer valid in that on September 26, 1989, the PSC Nominating Council voted not to submit Ms. Lorion's name to the Governor for appointment to the position.
At the time Ms. Lorion prepared her motion to the Board she was unaware that the PSC Council would be voting the same day that interviews with the applicants were held.
On September 27, 1989, she advised John Butler, Counsel for Licensee of her ignorance of the process and informed him that she would be notifying the Board.
Interveners regret any inconvenience this misunderstanding has caused to the Board and the parties.
Interveners still request that this Board grant their motion for all the good cause reasons listed in that Ms. Lorion's professional commitments would not enable her to meet the deadlines and granting of the motion would not hardship the parties Eince the amendments have been granted.
