October 3, 1989 MEMORANDUM On September 11, 1989 the Board received a filing titled " Request for Contention Reconsideration" from the Nuclear Energy Accountability Project (NEAP). Earlier NEAP had filed an "Ammended (sic) Petition for a Limited Appearance Statement" dated August 30, 1989. That document stated that NEAP will represent the interests of Thomas J.

Saporito, Jr. and other public citizens associated therein

... . Mr. Saporito signed both filings as Executive Director, NEAP.

Because NEAP is not a party to this proceeding, we consider its request to be in the nature of a written limited appearance statement pursuant to 10 C.F.R.

S 2.715(a) (1989). We note that the purpose of limited appearance statements is to alert the Board to areas in which evidence may need to be adduced. However, it is well settled that limited appearance statements do not constitute evidence. Louisiana Power and Licht Co., 17 NRC 1076, 1087

n. 12 (ALAB-732, 1983). We have examined NEAP's request as 1
