INTERVENERS' MOTION TO ADMIT CONTENTIONS ON THE SEPTEMBER 27, 1989 EMERGENCY PLAN EXERCISE

                  +.7%,_                   Anti-Pollution-League, (SAPL), and New England Coalition on Nuclear Pollution (NECNP), (hereinafter " Interveners",) moves this Board to admit for litigation in the above captioned p'toceedings the Contention filed herewith as Attachment A.

This motion is filed pursuant to S189(a) of the Atomic Energy - Act and is founded upon the grounds set forth below. The Interveners move this Board to permit them to have a hearing on ,s, AIL issues raised by the Contention and to permit them to engage in any discovery necessary to prepare for such hearing. The Interveners further request that the hearing on this Contention

  • of"the Seabrook Station Radiological Emergency Plan (SSRERP).

An exercise testing an applicants' on-site emergency plan I within:one. year prior to the issuance of a full-power license is required by 10'CFR Part 50, Appendix E, IV.F.1 where an

                         ,offsite exercise has been conducted more than one year prior to 4                         the issuance of,such a license.        "The purpose of the one year exercise requirement is to assure that adequate emergency response capability exists at the time of licensing." NRC Staff

CFR Part 50 E-IV F.1. (Onsite Exericise One Year Before Full-t Power License), page 8. .The standard against which such an L exercise must be judged is whether the exercise demonstrates 7

that the SSRERP can be impimented so that there is reasonable
                          -assurance that adequate protective measures can and will be 2-            taken in the event of a radiological emergency. 10 C.F.R.       S 50.47(a)(1). Such an on-site exercise must be designed so that ma3or portions'of the amergency response capabilities can be evaluated. 10 C.F.R.      50.47 (b)(14). The exercise that was conducted on September 27, 1989 was so truncated in its             -

scenario that major portions of the SSRERP were not demonstrated. The Contention attached in Attachment A k iEentifies specific major portions of the plan that were not

' exercised. Because the September 27 exercise was so abbreviated, it did not adequately test the Applicants' on-site emergency plan as required by 10 C.F.R. Part 50, Appendix E,

~ 4-s JURISDICTION The Board has jurisdiction, in this proceding over all the issues raised in the Contention. ALAB-916, 29 NRC Slip Opinion at 5-9 (5/25/89). Union of Concerned Scientists V. HEC, 735 F.2d 1437 (D.C. Cir. 1984) cert. denied, 469 U.S. 1132 (1985), requires this Board to provide the Interveners the opportunity to litigate inadequacies found in relicensing exercises. The right to litigate inadequacies in such exercises is not limited to litigation of demonstrated fundamental flaws in the plan itself. The Interveners also have the right to challenge the scope of the exercise. ALAB-900, 28 NRC 275, 285-287 (1988). As the Appeal Board noted in that decisicn: Indeed, the necessary, albeit implicit, assumption in the Commission's CLI-86-ll criterion for an admissible exercise contention is that the exercise itself must

be comprehensive enough to permit a meaningful test and evaluation of the

       'Z-                  emergency plan to ascertain if that plan is fundamentally flawed. [ Footnote omitted.]

An intervenor must therefore be allowed to challenge the scope of an exercise as too limited. To hold otherwise would allow the unreviewable scope of the excercise to

                 -          dictate the outcome of the exercise evaluation: i.e., an unduly limited exercise of only a plan's strong points would obviously reveal no fundamental flaws in the                                        -

plan and, conversely an unduly limited exercise of solely a plan's weakest areas would doom the evaulation to failure.

                !_ While ALAB-900 was addressing the litigation of offsite emergency planning scope contentions, no meaningful distinction can be made between scope contentions challenging offsite exercises and scope contentions challenging on site exercise

DEVELOPMENT OF A SOUND RECORD The Interveners will contribute to the development of a sound record through the litigation of the issues contained in the Cori- .cion attached hereto. The Contention set forth in Attachment A sufficiently identifies the issues that the Interveners seek to litigate. ALAB-918 (6/2/89) Slip Opinion

page 20. In support of the Contention, the Interveners will offer the testimony of witnesses who can verify that major portions of the SSRERP were not exercised. The witnesses are: Arthur Lonergan, Kelly Doherty, Lynn Collins, Theresa Mahoney, Barbara Tanski,. John Paolillo, Nan Pickard, Karen Ortolino, and Nancy Mason.

           'C-         Arthur Lonergan will testify that he was present at the Seabrook Dog Track on September 27, 1989 and that that facility was not used to monitor Seabrook Station evacuees as is specified in the SSRERP.

Kelly Doherty and Lynn Collins will testify that they were present at the Seabrook Fire Station and that the Seabrook Fire r Department embulance was not called upon to respond to a Medical emergency as is specified in the SSRERP. Theresa Mahoney, Barbara Tanski, John Paolillo, Nan Pickard, Karen Ortolino, and Nancy Mason will testify that they were present at the Newington EOF and that no offsite

     'd-                      the Commission's decision on the financial qualifications rule, there may be hearings scheduled on that issue.- At present, one can only speculate on when this proceeding is likely to end.

believe that a hearing schedule on the Contention would delay the proceedings significantly beyond that date. The issues L ptasented.in the Contention are relatively straightforward, and L will not involve a great deal of far-ranging discovery or 1 lengthy hearing proceedings. O-w before this Board, it will not increase the issues that under law and regulation must be resolved prior to the issuance of an operating license. THE STANDARDS APPLICABLE TO MOTIONS TO REOPEN THE RECORD DO NOT APPLY TO THIS PETITION The Interveners' adopt their arguments on their hearing rights regarding the June 22 and 23 low-power testing events as set forth in the Mass AG's May 31 motion, the Mass AG's June 21 Reply, the Interveners' July Contention; and the Interveners' Au~ gust 28 Motion. Those arguments are equally applicable to the rights and standards that apply to this petition to litigate the attached Contention. Furthermore, a proper exercise of an onsite plan is by regulation material to the issuance of an operating license since it is a mandatory precedent to an operating license under 10 CFR part 50, Appendix E SIV.F.1. 4 It is noteworthy that while in CLI-89-19, the Commission specifically addressed the fact that the Interveners have represented that they desire the opportunity to litigate the results of the onsite exercise and that the late-filed Contention standards would be applicable to any Contentions arising from the exercise, the Commission made no reference at all to any requirement to reopen the record. 29 NRC , Slip Opinion at page 2 and fn. 5, page 4. Since the Commission went out of its way to address the standards that would be applicable to any Contentions arising from the onsite exercise, it is inconceivable that the Commissioners would have, through oversight, failed to address the reopen the record standard if

The September 27, 1989 Seabrook Station onsite exercise was not-a full-scale onsite exercise and did not test all or even a significant number of the major observable portions of the Seabrook Station RERP ("onsite plan" or "SSRERP"). For this reason, the September exercise did not meet the regulatory requirements for the onsite exercise to take place within one yea,r of licensing (" pre-licensing one-year onsite exercise") as required by 10 CFR Part 50, Appendix E, IV F. 11. See alsn CLI-89-19. As a result, the September exercise provides no basis for the required finding of reasonable assurance as set forth in 10 CFR 50.47(a)(1) and (2), and that exercise is not in compliance with 10 CFR 50.47(b)(14).                               -      Attached as Exhibit 1 hereto is a section of the NRC's Inspection and Enforcement Manual ("IE Inspection procedure 82301") with its attachment, NRC's Exercise Evaluation Criteria for onsite exercises.                        IE 82301 states:

Sections 1, 2, and 3 [of the Evaluation Criteria] (control room, technical support center, and - emergency operating facility) must be evaluated annually and the entire procram must b2 RY_alual_ed in the initial 1 exercise pr1or in es.calatinn of pmwer bevond 1 (emphasis supplied). Indeed, El-1 of the Evaluation Criteria makes clear that the NRC team leader responsible for exercise evaluation: ATTACHMENT A

b o-- must review the exercise scenario to determine that there is reasonable assurance that all major y elements of the response as specified in 10 CFR 50, Appendix E, Part IV F will be tested and that it meets the intent of the regulations.1/ The " major portions" of the onsite plan which must be demonstrated in the pre-licensing one-year onsite exercise are those elements in the plan that are required by 10 CFR 50.47tb)(1)-(16) and set out and developed in NUREG 0654, II A-P. (Inspection Procedure 82302 (Exhibit 2) at 2-1 sets out the " major portions" to be demonstrated with reference to the NUREG sections.) Moreover, the June, 1988 onsite exercise (although itself not fully in compliance with the requirements

        .o f 10 CFR Part 50, Appendix E) was much broader in scope than the September, 1989 onsite exercise, yet the September exercise and not the June, 1988 exercise is the one that must be assessed against the requirements of 10 CFR Part 50, Appendix E,   IV F,  11. Attached as Exhibit 3 is the "Seabrook Station
     ~_ 1/ It may well be that NRC Staff approval of the scenario developed for the September exercise by the Applicants was based on Inspection Procedure 82302 " Review of Exercise Objectives and Scenarios for power Reactors," attached as Exhibit 2.      Pursuant to that Inspection Procedure, certain plan elements are to be exercised each year (Exhibit 2 at 2) while other elements can be exercised over a five-year exercise cycle.     (Exhibit 2 at 3.) However, the varying scope of the        ,

annual onsite exercise requirement described in Inspention  ! Procedure 82302 concerns Epst-licensing annual onsite exercises _ required by 10 CFR Part 50, Appendix E, IV F, 2 and not the pre-licensing one-year onsite exercise required by IV F, Tl which is to test "the entire program." ]: plants. I II. RESPONSIBILITIES

1. Regional Office - is responsible for implementation of the pro--

gram in accordance with requirements developed .by the program office including review, approval, and issuance of ; inspection reports and related enforcement action, and fc11cwup of inspec-

                                      -tion findings and enforcement actions.

2.. Team leader - responsible for the. overall inspection including i planning and. operation, integrating findings, chairing entrance and exit . interviews, . making inspection assignments, attending  ; the public critique by FEMA and issuing the inspection report. The team leader is responsible for informing appropriate re-

          ,                            gional management personnel about. significant inspection find-ings which may warrant immediate action.

The team leader makes logistical arrangements such as ensuring sufficient lodgitg and transportation accommodations will be available and making cer-tain that all team members have pertinent documents. He also , assures that all information necessary for site access is pro- l vided to the licensee. '

responsible for, participating in inspection planning and preparation, conducting exercise observations in assigned areas, and creparing input for the inspection report. III. DISCUSSION

1. Inspection planning and preparation -

The team leader is to assign .the observer sections contained in Part IV t.o the team members. Depending upon the scenario, it may be possible for one inspector to observe more than one area if the actions are

                                    ,  sequential (for example, an inspector could obseive the activa-                                                                       I tion of the Operational Support Center (OSC) and then could ob-serve a corrective action team).

Since some meeers of the team may not be from the Regiona'i Office, the team leader must ust his best judgment to make certain that all members are provided with the following information: (a) Scenario - Before the inspection the team leader must re-view the exercise scenario to determine that there is rea-sonable assurance that all major elements of the response as specified in 10 CFR 50, Appendix E, cart IV: F will be tested and that it meets the intent of the regulations. Th1s will permit the inspector to concentrate attantion on the personnel parti-cipating in the exercise and to better judge the. :dequtcy of the response. This review is also necessary to enable the inspectors to fill out the pre-exercise portion of the i evaluation criteria sections. (d) previous Inspection Repo7ts - The team leader should review previous emergency preparedness inspection reports to de- l termine if there are any items which could impact the exer-cise. For example, have there been any organizational or u'

personnel changes; were any deficiencies- noted in either the plan or procedures; have there been any. equipment { changes;' etc? Such information should be posed on to the individual assigned to that area of observation / evaluation. 1 l (c) Evaluation Criteria - Part IV of this document consists of - a series of evaluation criteria subdivided by functions or  ! emergency centers. Before the exercise the inspectors, , based on a revies of the scenario, emergency plan and implementing procedures, should review applicable 6ections of Part IV and complete the column labeled " Expected Li-ter.sce Response." Inspectors should include items such as the prescribed time of scenario events that will trigger 4 a retposse, procedures to be implemented, actions pre- I scribed by procedure, or personre) who are assigned to re-  ! spond. 2. Meeting with Licensee a Before the exercise the team leader should arrange for the inspection team to meet with the ' ,

licensee's observer team. At this meeting any last-minute  ! changes to the scenario arc discussed EM a schedule of events  ! up to and including the exit interview it, tentatively estab-lished. The licensee should also provide a list of the u mbers of the licensee's observer team and their locations for the exercise.

3. Exercise Observation a The inspector should plan to arrive at his . duty station ~ at least 15 to 20 minutes before that area is scheduled to be ' involved in the exercise. He should briefly observe the room, facility, and personnel to determic.a the general state of activity (for example, is the facility set up in a " normal" mode or has it been pre-arranged into en emergency I mode). He should note which personnel are " players" and which  !

are observers. I He should also observe if any discussions are being held with the players that could prejudice their response. ' After the exercise has started, the inspector should use the evaluation  ! criteria sections which had been partially filled out before the exercise to record comments. These should describe incor- l rect performance, performance not in accordance with procedures and other pertiner<t information as necessary (for example, the time at which a specific event took place; whether the response was prompt, etc).

) During the exercise the inspectors should not interrupt the players and should keep conversation with them to a minimum. If questions must be asked or clarification is needed, the inspector should attempt to get the information from the 3 licensee's observer and not from the player. Under no cir-cumstances should the inspector suggest to a player how to respond. If necessary, logs may be inspected o'r selected personnel interviewed following the exercise to clarify any - points for the inspecter.

4. Post-exercise Responsibilities l

(a) Inspector Meeting - After the exercise, the inspection l team should meet as a group to discuss its findings. Inspectors should prepare brief, written summaries and give them and the completed evaluation criteria sections to the team leader. The team leader will summarize the findings and ascertain that the inspectors are generally ' in agreement with this summary that will be presented to the licensee. NRC INSPECTION MANUAL pRpB INSPECTION PROCEDURE 82302 REVIEW OF EXERCISE OBJECTIVES AND SCENARIOS FOR POWER REACTORS FROGRAM APPLICABILITY: 2513, 2515 82302-01 INSPECTION OBJECTIVE To provide guidance for the review of proposed licensee exercise objectives and scenarios. 82302-02 INSPECTION REQUIREMENTS 02.01 Determine whether the licensee's proposed objectives and scenario were received in sufficient time before the exercise to permit appropriate NRC review. 02.02 Determine whether the licersee's proposed exercise objectives meet commitments and provide reaserable acceptance criteria. 02.03 Determine whether the licensee's emergency preparedness exercise objectives and scenario previde an adequate framework for the type and scope of exercise proposed. 02.04 Determine whether the licensee's proposed exercise scenario will neet the previously submitted exercise objectives. 82302-03 INSPECTION GUIDANCE . 03.01 General Guidance. Technical evaluations of the scenario and exercise control are the responsibility of the licensee. The scenario should be evaluated primarily on relative credibility and timing of ever.ts. The licensee should review and verify the , technical details such as, but not limited to. engineering operational parameters, engineering logic, source term, radiological instrumentation data, and units of data provided by controllers. Scenario-related problems and poorly controlled exercises will be evaluated during the exercise. The in-house inspection of the sce-narios should be against the requirements of 10 CFR 50.54(t), 50.47(b)(14), and Section IV.F. of Appendix E te 10 CFR 50 in preparation for conducting onsite inspections under Inspection Procedure (IP) 82301. Results of these inspections should be documer.ted in the Inspection Reports for inspections completed under IP 82301. Issue Date: 03/24/89

3. The level of specificity of the objectives should provide measurable and/or observable criteria for evaluators. The objectives should also include a description of adequate or acceptable levels of response.

For the full-participation biennial exercise, the NRC team leader should contact FEMA to confirm that'offsite objectives are consistent with exercise frequency requirements, testing communication interfaces between onsite'and offsite facilities, and testing of the public notification systems,

c. Inspection Requirement 02.03. Exercise objectives are dependent on the type of exercise conducted. Descriptions of the types of exercises currently conducted by licensees may be found in Inspection Manual Chapter (IMC) 2500, Appendix 1.
1. Exercise Objectives. The reviewer should give particular atten-tion to detail in the review of exercise objectives because they provide the basis for development of the exercise scenario and acceptance criteria for exercise evaluation. Objectives should be. commensurate with the type and scope of exercise proposed. 'Information Notice 87-54, " Emergency Response Exer-cises," reminds licensees that off-year exercises are not required in order to proceed to severe core damage situations. -

These exercises can provide an opportunity for more realittic emirrgency response training and evaluation of licensee staff. Emphasis should be placed on the timely evaluation of exercise objectives to provide enough time for the licensee or applicant to change or revise objectives in advance of the exercise without hardship. MPCS legger trend sheets detailing dose assessment and operational treno data will be issuto every 15 minutes provided the logger trend feature is accessed. -Simulator controllers will change the operational trend data as player action changes the accident secuence: however, no operational action will be allowed which changes the main timeline. The use of the Safety Parameter Display System (SPDS) will be simulated - during the exercise.
