AND REPLY Applicants move the Appeal Board for leave to file the following reply to the recent filing of the Attorney General of The Commonwealth of Massachusetts (MAG) entitled:

RESPONSE OF THE MASSACHUSETTS ATTORNEY GENERAL TO THE APPLICANTS' MOTION TO STRIKE THE MASS AG'S SEPTEMBER 15 COMMENTS AND kPPLICANTS' MOTION TO SUBMIT FURTHER ANALYSIS OF MONITORING CAPACITY ISSUES:

In his response MAG relies on certain language taken from the supplementary information published with the recent amendments to the Rules of Practice 1 in order to argue that i

ig; th'e-amendment made to 10 CFR S 2.762 does not apply in the Seabrook proceeding.

The language quoted speaks only to

" contentions" filed in proceedings initiated before the effective date.

Obviously, what the Commission was saying2 was that the rules governing the framing of contentions would not apply to ongoing proceedings i.g.,

the anendments to 10 CFR 5 2.714.

No such similar limitation was placed upon the other amendments made to the remaining rules. 'Had the Commission wished to do that it would simply have said that the amendments do not apply to any proceeding initiated after the effective date, rather than confining the limitation to

" contentions in proceedings."

In short the amended rule is applicable and does deny MAG standing to make any of the arguments made in the original filing.

The latest filing is more of the same:

arguments that could, and should, have been addressed to the Licensing Board but were not so addressed.

Frankly there is a thorny question as to whether a statement in the statement of reasons which L

accompanies a rule promulgation can have the effect of making a rule applicable only to future i

proceedings when such language is not actually included in the regulation itself.

However, that question need not be resolved for this proceeding at this time.
