MEMORANDUM AND ORDER Pending before us is the Licensing Board's February 2, 1989, referred ruling concerning certain environmental r

contentions. See LBP-89-6, 29 NRC . All of the parties' briefs are now on file. Subsequent to the filing of the applicant's brief and shortly before the filing of the NRC staff's brief, the U.S. Court of Appeals for the Third Circuit issued a lengthy decision in Limerick Ecology Action, Inc. v. NRC, Nos. 85-3431, et al. (February 28,.

1989). Neither the applicant's nor the staff's brief thus discusses the possible relevance of that decision to the l issues before us in this proceeding. The joint brief for interveners the New England Coalition on Nuclear Pollution l l

and the Commonwealth of Massachusetts (filed a month after the Third Circuit's decision), however, contains substantial discussion of that case. We therefore request applicant and 8904130170 DR 890407 ADOCK 05000271 ,

l the NRC staff to file supplemental briefs limited to a discussion of the Limerick decision, its relevance to the instant case,.and the related arguments of the interveners.

Such briefs are to be received by us and the other parties no later than April 21, 1989.

Interveners have requested' oral argument on this matter. The decision whether, and if so when, to hold oral argument will be made in the near future.
