SUPPLEMENTAL MEMORANDUM IN. SUPPORT OF INTERVENERS' APPLICATION FOR STAY OF EFFECTIVENESS OF LBP-89-04 PENDING ITS APPEAL On February 8, 1989, the Interveners filed their Application for Stay of Effectiveness of LBP-89-04 Pending Its Appeal.
The Interveners hereby request leave to file this memorandum apprising the Commission of the progression of the appeal on the merits of LBP-89-04 before the Appeal Board, as well as citing an important additional case in support of the stay application.
The events before the Appeal Board are material to the Commission's consideration of the Interveners' stay application and have occurred since its submission.

z i-l application and the Interveners apologize for not doing so.
However, the case is on point, out of the D.C.
Circuit, and important for the Commission's consideration of these issues.

On February 10, 1989, at the request of the Interveners, the Appeal Board ordered an expedited schedule for its review on the merits of LBp-89-04, pursuant to that order, briefing is complete and oral argument is now scheduled for April 21, 1989.
The unusual circumstance that an appeal on the merits is before the Appeal Board at the same time that a request for stay is brought before the Commission (under CLI-88-10) gives rise to the possibility of inconsistent results on the merits reviews before the respective tribunals.
In light of the convergence of these appellate decisions on the merits and the stay, the Commission may wish to consider ordering the Appeal Board tc expedite its decision on appeal while simultaneously postponing its decision on the stay pending the outcome of that decision.

In the stay application, the Interveners cited Union of Concerned Scientists v.
NRC, 735 F.2d 1437 (D.C. Cir 1984) for the proposition that the Licensing Board erred in applying the motion to rec 7en standard of 10 C.F.R. 52.734, as well as the late-filed contention standard of 10 C.F.R. 52.714, to the on-site exercise contention.
The Interveners neglected to cite San Luis Obisoo Mothers for Peace v.
NRC, 751 F.2d 1288 (D.C.
Cir. 1984) for the same proposition.
The Interveners call the Commission's attention specifically to pages 1316-1317 of the San Luis Obispo case holding that " consideration of a request. _ _ _ - _ _ _ _ _ _ _ - - _
to reopeh the record.does not satisfy the requirements of section 189(a).
In conjunction with the UCS case holding that exercise results are " material" to licensing decisions for purposes of section 189(a), San Luis Obispo leads to the conclusion that clear error was committed by the Licensing Board.
