INTRODUCTION As part of its application for a certificate of compliance,10 CFR 76.35(g) requires that USEC

- provide an envirot. mental compliance status report describing the status of Federal, State, and local environmental permits, licenses, approvals, and other entitlement, as well as the compliance status with applicable environmental quality standards and requirements as described in 10 CFR 51.45(d) that are applicable to USEC operations. In addition,10 CFR 76.35(g) requires that the compliance status report contain avahblc environmental and effluent monitoring data. USEC's Environmental Compliance Status l

Report for the Portsmouth Oaseous Diffusion Plant (PORTS) is provided below. This report covers the l

compliance status of PCRTS _with applicable Federal, State and local permits, licenses and other-l entitlement through the end of calendar 1997 (CY) 1997. Due to the required schedule for submission l

of this document, effluent and environmental data and the public dose assessments for CY 1997 will not l

be available in time for inclusion here. Consequently, the effluent and environmental data and dose l

assessments for CY 1996 are provided instead.

2.

DESCRIPTION AND CO31PLIANCE STATUS OF PERh1ITS, REGISTRATIONS, AND OTIIER ENTITLE 51ENTS, AND OTHER APPLICABLE ENVIRONMENTAL QUALITY STANDARDS AND REQUIREAIENTS USEC is required to operate PORTS in compliance with a number of Federal and State mvironmental permits, registrations, other entitlement, and other applicable environmental quality standards and requirements. The following matrices (Tables 1 and 2) identify each of the environmental permits that govern USEC activities at the PORTS. They also identify the principal permit limits and contain a l

summary statement on the status of USEC compliance.

i 2.1 CLEAN AIR ACT Pursuant to the Federal Clean Air Act (CAA), as amended, and corresponding State laws and regulations, USEC currently holds four active air permits (Permits-To-Operate) issued by the Ohio l

Environmental Protection Agency (OEPA). USEC also has 99 " registered" sources, which are sources that l

l l

fall below State specified criteria and are " registered" by OEPA in lieu of issuing formal permits.

An additional 104 permit applications applicable to USEC operations have been submitted to the l

l OEPA as well as a timely application for a Title V Permit. OEPA issued permits for 58 of these sources, l

l all of which are being appealed by USEC. Until the appeals are settled, these permits are not in force.

l l

The remainder of the sources have been declared to be exempt from permiting requirements by the OEPA.

l The Title V permit ?pplication is awaiting action by the OEPA, and will supersede all of the individual l

Permits-To-Operate when it is issued.

l l

ECSR-PORTS April 15,1998 Rev.19 USEC operations at PORTS are covered under the Federal National Emissions Standards for l

Hazardous Air Pollutants (NESHAP) for radiological emissions (40 CFR Part 61 Subpart H), which l

constitutes a " permit-by rule" for all DOE owned nuclear facilities. USEC is in compliance wit' :he l

NESHAP limits on radionuclides emissions l

l As reflected in Column 3 of Table 1 USEC was in compliance with its State air emissions permit j

limits and conditions during 1997.

l USEC is in compliance with Federal regulations issued pursuant to the CAA that govern management of asbestos.

The PORTS fire d:partment conducts its own fire training exercises on property leased by USEC from DOE. USEC is n compliance with its OEPA permit governing open burning for this purpose.

i 2.2 CLEAN WATER ACT As of the end of 1997, USEC's NPDES permit encompasses eight external outfalls, three internal l

outfalls, af.d three imaginarv outfalls (alternative limits for three of the external outfalls) discharging l

process and storm water from USEC-leased facilities along with four monitoring points in the receiving l

streams. Permit limits for these outfalls are summarized in Table 2.

During 1997, USEC was in compliance with the permit limits with the following exceptions:

ECSR-PORTS April 15,1998 Rev.19 None of the exceedances were considered a significant noncompliance by the OEPA and none had i

any measurable impact on water quality or aquatic life. The following information was provided to the l

OEPA, who took no further action.

l l

All of the foam exceedances were traced to operational problems at the plant laundry. These l

problems caused excess concentrations of laundry detergent to intermittently accumulate in the wash water l

which, in turn, caused foam at the Sewage Treatment Plant (Outfal! 003).

l l

The TSS exceedances at Outfalls 010 and 005 were caused by heavy rainfalls. TSS concentrations l

at Outfall 010 were within the daily limits, but the flow-weighted average exceeded the 30-day average j

limit. Outfall 005 is normally dry and consequently collects windborne solids (i.e. dust) between flow l

events. A permit modification is being pursued to address this problem. The TSS exceedance at Outfall l

003 was a mass limit exceedance caused by a high flow rate rather than a high concentration of suspended l

solids.

l 1

No source of trichlorethylene at Outfa:1004 could be identified and its actual presence in the outfall l

has beer, questioned. Trichlorethylene has not been used at PORTS for several years, although it is l

present in onsite groundwater plumes. The original sample analysis could not be refuted, however, due l

to the lack of a suitable duplicate sample.

l l

The pH exceedance was caused by a malfuncuoning pH control system on the X-700 l

Biodenitrification Facility (Outfall 604L This is an internal outfall which discharges to the onsite Sewage l

Treatment Plant rather than to the environment. There was no corresponding exceedance or disturbance l

at the Sewage Treatment Plant.

The unanticipated bypass was caused by a heavy rainfall which overfilled the lagoon at X-621 l

(internal Ou. fall 602). The lagoon overflowed directly to the South Holding Pond without intended l

treatment at the X-621 facility. There was no impact at the discharge of the South Holding Pond (Outfall l

002).

l l

The two unpermitted discharges were caused by two separate pumping problems which caused a l

water tani to overflow to the Northeast Holdi1g Pcad (Outfall 011) in May and an equalization basin at l

the X-611 Water Treatment Plant to overflow dhectly to Little Beaver Creek in November. In both cases, I

there was no adverse impact on the environment.

l 2,3 RESOURCE CONSERVATION AND RECOVERY ACT i

USEC generates hazardous and mixed waste, and complies with all requirements for generators,

)

including accumulation of waste in satellite accumulation areas (SAAs) and accumulation of waste in l

904ay accumulation areas (90-DAAs). DOE operates all permitted treatment and storage facilities under l

I a RCRA permit. USEC received one NOV in 1997 regarding the control of two SAAs. The OEPA noted l

1 that these SAAs could nut be locked while the process operators were out of sigh

  • of the SAAs for lunch l

or other breaks. The plant installed locks on the waste containers and the NOV was closed by OEPA l

without further action.

a ECSR-PORTS April 15,1998 Rev.19 USEC is currently shipping the majority of USEC-generated hazardous and mixed waste directly l

from 90-DAAs to offsite treatment, storage, and disposal (TSD) facilities. Until treatment facilities are l

found for all mixed wastes some USEC mixed waste will be sent to DOE-operated storage units.

l USEC is also in compliance with OEPA requirements for management of used oil.

2.4 STORAGE TANKS USEC operates 11 underground storage tanks (USTs): 9 containing diesel fuel,1 gasoline, and I kerosene. The tanks are registered under and in full compliance with all regulations governing USTs, as issued by the Ohio State Fire Marshall Bureau.

USEC also operates approximately 1C3 aboveground storage tanks.

A Spill Prevention, Countermeasures, and Control Plan has been submitted to the United States Environmental Protection Agency (USEPA) and OEPA for these tanks pursuant to the CWA, and a Facility Response Plan has been prepared pursuarr to the Oil Pollution Act of 1990.

2.5 POLYCIILORINATED BIPHENYLS USEC leases transformers and capacitors from DOE that contain greafer than 50 parts per million (ppm) polychlorinated biphenyls (PCBs). Matters regarding the management of equipment, as well as the storage, disposal. and attention to past spills of PCBs are the responsibility of DOE pursuant to a Federal Facilities Compliance Agreement between DOE and the USEPA and the lease agreement between DOE and USEC.

2.6 EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW ACT; RELEASE REPORTING UNDER THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY ACT USEC is in compliance with requirements of the Emergency Planning and Community Right-to-Know Act (EPCRA), including the preparation of an emergr.ncy response plan under Section 302, hazardous chemical reponing under Sections 311 and 312, and ioxic chemical release reporting under Section 313.

In addition, during 1997, USEC had no relesses of hazardous substances in reportable quantities subject I

I to reporting requirements under Section 103 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended.

3. NATIONAL EMISSION STANDARDS FOR HAZARDOUS AIR FOLLUTANTS Under the requirements of 10 CFR 61 (NESHAPS) Subpart H, emissions of radionuclides to the ambient air from DOE facilities must not exceed those amounts that would cause any member of the public to receive a committed effective dose equivalent (CEDE) of 10 mrem / year.

l In 1996, airborne radionuclides emissions from PORTS due to USEC operations resulted in an l

estimated annual EDE of 0.14 mrem / year to the most exposed member of the public. This ir.cludes both l

measured releases from the major process vents and estimated releases from smaller vents. As in past l

years, the maximally exposed sector of the reservation boundary was the ENE sector. Airborne l

radioactivity concentrations predicted by the calculations were in agreement with airborne radioactivity l

concentrations measured by ambient air samplers. The 1997 dose assessment will not be completed in time l

to be included in this document.

l Since 1985, the ratio of the maximum net measured gross alpha activity to the maximum predicted l

total uranium concentration has ranged from 0.4 up to 2.6, with an average ratio of 1.3. Over the same l

period, the ratio of the maximum net measured gross beta activity to the maximum predicted technetium l

and uranium drughter concentrations has ranged from 0.2 up to 4.8, with an average ratio of 2.3. In 1996, l

these ratios were 2.5 for gross alpha activity and 1.5 for gross beta activity. Approximately 28 percent l

of the predicted maximum public radiation dose was due to alpha emitters (i.e. uranium isotopes).

l

4. ENVIRON'.IENTAL MONITORING DATA In addition to the data required by environmental permits and regulations, USEC monitored environmental media for the purpose of identifying possible effects of plant emissions and effluents on the surrounding area. This included ambient air, soil, and sediment sampling, sampling of food crops and vegetation, monitoring of direct radiation from plant sources, USEC-leased outfall waterborne effluents, and surface water. The data obtained from this monitoring are summarized in Tables 4 through 12.

In addition, PORTS calculates an annual public radiation dose due to waterbome radioactive effluents l

from USEC-leased outfalls using Regulatory Guide 1.109 pathways. The maximum public radiation dose j

due to liquid effluents from USEC activities in 1996 was 0.003 mrem / year (50-year Committed Effective l

Dose Equivalent).
