TERMINATION OF NRC RADIOACTIVE MATERIALS LICENSE SNM-844 (TAC NO. L31014)

Dear Dr. Enstice:

The U.S. Nuclear Regulatory Commission (NRC) has reviewed the records provided with your December 16,1997, response to our November 5,1997, request for additional information (RAl), which included documentation of the transfer of the Pu-Be source and the uranium suberitical assembly core, and the results of the past leak tests associated with the sealed Pu-Be source. Based on review of this formation and your representations, the NRC staff has concluded that:

1. All licensed radioactive materials have been removed from your facility in accordance with NRC requirements in 10 CFR 70.38;
2. The sole sealed Pu-Be source never leaked, both while in your possession and upon arrival at the ultimate destination in Los Alamos National Laboratory. In addition, the suberitical assembly core did not leak or activate adjacent components and materials.

Consequently with this demonstration, a final status survey is not required in accordance with 10 CFR 70.38(k)(3)(ii);

3. Residual radioactive cont &mination attributable to licensed activities do not exceed current NRC criteria for release of the site in accordance with 10 CFR 20.1402. This was supported by records review and general area radiation survey measurements performed by NRC staff members Heather Astwood and Thomas Pham during a December 11, its97, site visit; and
4. The decommissioning records discussed in Part 70.38(P)(4) are not applicable to your facility. Consequently, you are not required to submit these records.

Based on these conclusions, your requested license termination met Type i decommissioning criteria in accordance with NRC guidelines described in NUREG/BR-0241, 'NMSS Handbook for Decommissioning Fuel Cycle and Materials Licensees." Therefore, no further remediation or actions with respect to NRC regulated material are required. Your facility is suitable for unrestricted use, and NRC license number SNM-844 is hereby terminated. The NRC will require cleanup of the facility only if based on new information, it determines that the criteria above were not met and the residual activity remaining at the site could result in a significant g threat to public health and safety as stated in 10 CFR 20.1401(c). -
