I APPENDIX A NOTICE OF VIOLATION Gates Formed-Fibre Products, Inc.

As a result of the inspection conducted on June 27, 1989, and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (Enforcement Policy) (1988), the following violation was identified:
10 CFR 31.5(c)(2) requires any person who acquires, receives, possesses, uses or transfers byproduct material in a device pursuant to a ger.n al license shall assure that the device is tested for leakage of radioactive material and proper operation of the on-off mechanism and indicator, at no longer than six-month intervals.
Contrary to the above, as of June 27, 1989, three devices each containing 300 millicuries of americium-241 had not been tested for loakage or for operation of the on-off mechanism at six-month intervals.
This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Gates Formed-Fibre Product, Inc.
is hereby required to submit to this of fice within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date wSen full compliance will be achieved.
Where good cause is shown, consideration will be given to extending this response time.
