.During.a"' telephone. conference call with the Nuclear Regulatory Commission

(NRC) Staff conducted on August 31, 1989, Toledo Edison representatives i

' discussed'a situation in which the Davis-Besse Nuclear Power Station intends

)

to'use the provisions of Generic Letter 89-09 (ASME Section III Component

. Replacements) to. replace the service water system to component cooling water.

j system heat exchanger outlet valves. The existing valves are butterfly valves 1

which are automaticallyLthrottied based on the temperature'of the component i

cooling water system. These valves have historically experienced problems.;

The condition has been extensively reviewed by Toledo Edison and an'outside l

. consultant and the recommended solution is replacement of the butterfly-valves with ball valves, which have a dual flow coefficient. This particular ball valve. design is not available currently as an ASME Code N-stamped valve.

Toledo Edison'has planned replacement of these service water valves during the l

. sixth refueling; outage currently scheduled to begin in February 1990.

i Toledo' Edison reviewed Generic Letter 89-09 and determined that the replacement situation met the provisions of the Generic Letter which allows l

the valves to be purchased as ASME Code Section III components without the ASME. Code N-stamp. The August 31, 1989 telephone conference call was conducted to both advise the NRC of Toledo Edison's intent to follow the l:

provisions of the Generic Letter and receive verbal confirmation from the NRC Staff that the Generic Letter was applicable to the situation.

This letter documents that following the NRC Staff's consideration of the situation,.the NRC Staff notified Toledo Edison on September 8, 1989, that they had considered.the service water valve replacement as described on August 31,'1989 and confirmed that the provisions of Generic Letter 89-09 vere applicable to the situation.
