BYRON NOTICE OF VIOLATION (NRC INSPECTION REPORT

NO. 50-454/98005(DRP); 50-455/98005(DRP))

Dear Mr. Kingsley:

This will acknowledge receipt of your letter dated April 14,1998, in response to our letter dated

March 16,1998, transmitting a Notice of Violation associated with inspectbn Report

No. 50-454/98005(DRP); 50-455/98005(DRP). We have reviewed your corrective actions and

have no further questions at this time. These corrective actions will be examined during future

inspections.

Your letter also requested an explanation of the basis for citing several examples of violations of

regulatory requirements as individual violations, via as one violation with multiple examples.

You referenced six examples of violations of fire protection procedures which were cited as three

separate violations in Inspection Report No. 50-454/98005(DRP); 50-455/98005(DRP). You also

asked that the NRC consider grouping similar examples as one violation.

After further review and evaluation, we have reconsidered the violations and have combined

violation 50-454/98005-05's(DRP); 50-455/98005-05b(DRP) with violation

50-454/98005-05c(DRP); 50-455/98005-05c(DRP) as one violation with five examples. We have

also concluded that violation 50-454/98005-05a(DRP); 50-455/08005-05a(DRP) is distinctly

diverse from the remainder of the examples and that it should stand as a separate violation.

This is reflected in the enclosed Notice of Violation (Notice) Errata and should be used to replace

the Notice issued with inspection Report 50-454/98005(DRP); 50-454/98005(DRP). Since your

previous response addressed all the violations, you need not respond to the new violations
