NRC STAFF THIRD STATUS REPORT CONCERNING SETTLEMENT AGREEMENT I. INTRODUCTION On March 27, 1989, the Atomic Safety and Licensing Board issued a Memorandum and Order in which it, among other things, directed the NRC staff to file a monthly report indicating the status of the Staff's review of the settlement agreement between Philadelphia Electric Company (PE) and the Commonwealth of Pennsylvania. The Staff herein provides its third status report.

II. STATUS REPORT In the NRC Staff's second status report reference was made to a meeting held on April 28, 1989 to pursue resolution of concerns previously i identified by the Staff. As a result of that meeting and further discussions, the parties have reacheJ, in principle, a resolution of the outstanding issues relating to the pending matter as well as other issues. An agreement is being prepared in final form for submittal to the Staff. It is anticipated that the staff will approve the agreement in a Confirmatory Action Letter. When this process is completed, steps will be taken to conclude the instant proceeding 8906090069 890601
