ENCLOSURE RESPONSE TO GA0 RECOMMENDATION Recommendation:
The GA0 stated that to ensure the safe restart of each nuclear power plant which has been shut down to correct safety and/or management problems, criteria should be developed that describe both NRC and utility actions that must be taken before allowing restart. The GA0 further stated that these criteria should be flexible enough to allow NRC to add requirements on a plant-by-plant basis giving consideration to overall design, personnel, and management. The GA0 recomended that at a minimum the criteria include review and approval of the utility's corrective action plan, inspections to ensure the actions are taken, independent review of NRC's actions, and public participation.
NRC Response:
The NRC agrees with the GAO position that specific criteria for evaluating the readiness for restart of plants shutdown to correct safety and/or management problems should be developed. The NRC staff is planning to develop such criteria in the next fiscal year based on the programs utilized in recent restart reviews for Peach 'tottom, Pilgrim, Rancho Seco, and Sequoyah, and the general guidelines issued in November 1988 and discussed in the GA0 report.
These criteria will be more specific than current guidelines, especially regar ding:
(1) independent review of NRC staff actions; (2) public partici-pation; (3)(order, confirmatory order, or confirmatory action letter); and (4) the method of establishing necessary actions by the licensee prior to restart the NRC's plan for technical review and inspection.
The criteria will also include as clear a definition as possible of those restart cases where use of these steps would be appropriate. The criteria will be flexible enough to accommodate plant-specific issues to the extent required. The new criteria will be incorporated in Part 0500 of the NRC Manual.
