Dear Mr. Thcmpson:

On February 28, 1989 Senator John Glenn informed you that you will be deposed on Thursday, March 2,1989. He also requested that you bring all documents concerning an ongoing OIA investigation involving allegations by Mr. Ellison and which relate to NRC employee Roger Fortuna.

This is to inform you that the documents requested are agency records and are not to be provided by you to the Comittee on Governmental Affairs without the Connission's express authorization. The Comittee on Governmental Affairs is being informed that the Comission has so advised you.

Additionally, you are requested not to discuss anything concerning the investigation and associated personnel action with the Comittee except for questions related to the policies and procedures employed in conducting those activities. We are informing the Comittee that we have advised you to respond only to the procedural aspects of the investigation, and we are requesting that they so limit their questioning of you.
